The scum-suckers that run the NFL have just decimated what little respect I had left for them by threatening the 2015 Superbowl to not be played in AZ if that bill got signed. I am sure my lack of respect for them, will keep them up at night as well.
The HomoNazi (HT to Hamous for the apt moniker) Borg strike again. I wonder what would have actually happened if Brewer did sign the bill and the NFL pulled the Superbowl; would the State of Arizona have a case of breech of contract against the NFL and be able to sue for treble damages (they surely must have spent a bundle in preparation for the event) plus punitive damages?
One thing we all know is that as long as people/states/organizations continue to cave to the HNBs they will continue to press their outrageous demands even further. -

American t-shirts are banned from a school on Cinco de Mayo.
Officials at a Northern California high school acted appropriately when they ordered students wearing American flag T-shirts to turn the garments inside out during the Mexican heritage celebration Cinco de Mayo, a federal appeals court ruled Thursday.
The 9th U.S. Circuit Court of Appeals said the officials’ concerns of racial violence outweighed students’ freedom of expression rights. Administrators feared the American-flag shirts would enflame the passions of Latino students celebrating the Mexican holiday. Live Oak High School, in the San Jose suburb of Morgan Hill, had a history of problems between white and Latino students on that day.
The unanimous three-judge panel said past problems gave school officials sufficient and justifiable reasons for their actions. The court said schools have wide latitude in curbing certain civil rights to ensure campus safety.1) Why are the Mexican students not taught to respect the country they live in, nay, may even be citizens of?
2) Why aren’t Mexican students taught not to beat up students who are also celebrating their heritage?
3) Why aren’t American students taught not to beat up students who are also celebrating their heritage?
4) What is it about a t-shirt that can instigate violence? (See #2,3)
5) Why can’t the school manage the students so that their freedom of speech isn’t infringed?
6) If the courts say that “safety” is a good enough reason to restrict freedom of speech, how long before all conservative talk is banned? (Because, you know, most of the vitriol and bad behavior comes from the conservative side. /snark off)
Maybe we should sit them all down and have a (root) beer together. That should smooth things over. -

David Bernstein, one of my favorite law profs, invited Professor Doug Laycock, prominent law and religion scholar at the University of Virginia, to write a short post to the Volokh Conspiracy about the actual wording and meaning of the controversial, vetoed law on religious freedom in Arizona.
According to the New York Times, and as best I can quickly gather, most other news sources, Arizona Governor Jan Brewer vetoed a bill “that would have given business owners the right to refuse service to gay men, lesbians and other people on religious grounds.”
SB1062, which would have amended Arizona’s Religious Freedom Restoration Act, was been egregiously misrepresented both before and after the veto. The federal government and eighteen states have Religious Freedom Restoration Acts (RFRAs). Another twelve or thirteen states interpret their state constitutions to provide similar protections. These laws enact a uniform standard — substantial burden and compelling interest — to be interpreted and applied to individual cases by courts. They rest on the sound premise that we should not punish people for practicing their religion unless we have a very good reason. These laws have produced surprisingly few cases, on gay rights or any other issue; before the current litigation on contraception, most people had never heard of the federal RFRA. -

If Brewer had the temerity to actually sign the wissin bill and make it law, which mirrored US law, and the NFL then chose to back out on their contract obligations they, the NFL, could be held liable for 3 times the amount that AZ spent in preparation for the game plus court costs plus attorneys fees, plus punitive damages, right? -

Good morning Hamsters. Climbing up the rollercoaster again, warming from 52 this early am. Another rocket ride downside comes by Sunday. Misty and a whole 56; yesterday’s beautiful sunny experience is gone, but upper 60s is expected by the soothsayers.
Kin in Madison are in still in the deepfreeze, -11 forecast for early this am, crawling up to maybe teen digits. They haven’t seen 32 for over a week. Grim indeed. And really depressing. And the traditional March blizzard is yet to come during St. Patrick’s Day week.

That combined with recent celebration of revealed homosexual players past, present, and prospective makes one wonder how easily management leaps upon the bandwagon. He opined it could be called the National Fairy League. A fair comment IMHO.

Girl saves her brother’s life – by shooting a cougar that was stalking him.
The animal appeared to be moving in the direction of Shelby’s 13-year-old brother, who was unaware of the danger as he made his way toward the basement door with a bag of animal feed in his hands.
The girl’s father, Tom White, was home at the time, but Shelby was the only one in the family with a tag – a permit to legally kill a cougar.
‘He said, “Shelby, grab that gun and go shoot that cat,”’ White said, adding that the 11-year-old ‘wasn’t scared a bit’ as she pulled the trigger.The 64-year-old farmer used to be a hunter safety instructor and taught all his grandchildren how to properly use weapons.
According to her grandfather, the girl’s 9-year-old brother, Cody, also bagged himself a cat who wandered onto the ranch and killed one of his calves. A game warden from the Fish and Wildlife Department was present and gave the boy, who had a permit, the green light to pull the trigger.

Here is Eugene Volokh’s excellent commentary on the decision.This is a classic “heckler’s veto” — thugs threatening to attack the speaker, and government officials suppressing the speech to prevent such violence. “Heckler’s vetoes” are generally not allowed under First Amendment law; the government should generally protect the speaker and threaten to arrest the thugs, not suppress the speaker’s speech. But under Tinker‘s “forecast substantial disruption” test, such a heckler’s veto is indeed allowed.
The 9th Circuit decision may thus be a faithful application of Tinker, and it might be that Tinker sets forth the correct constitutional rule here. Schools have special responsibilities to educate their students and to protect them both against violence and against disruption of their educations. A school might thus have the discretion to decide that it will prevent disruption even at the cost of letting thugs suppress speech.
Yet even if the judges are right, the situation in the school seems very bad. Somehow, we’ve reached the point that students can’t safely display the American flag in an American school, because of a fear that other students will attack them for it — and the school feels unable to prevent such attacks (by punishing the threateners and the attackers, and by teaching students tolerance for other students’ speech). Something is badly wrong, whether such an incident happens on May 5 or any other day. -

She has cleaned up Hubby’s desk (a daunting task).
She has cleaned up and organized all of my real estate and other materials; they are all shelved.
My faith formation materials are also organized, except for my weekly folders, which have been downstairs.
We retrieved my box of weekly class materials. She is now going to re-organize them (they start out organized at the beginning of the year, but entropy attacks them as the year goes on).
She is also going to prepare my retreat materials for March 8th.

Yep, I bet an appeal to the taxing authorities is going to reduce their tax load. There’s no way the gubmint is going to keep their greedy hands off. This couple will HAVE to sell the coins, just to pay the taxes.
And they’ll have to pay it in April or pay penalties. This means that they are now distressed sellers, and may not make as much as originally planned.

11 / 23 – I’m confused. Let’s see; a school district has issues between white / Hispanic students on a more frequent basis than just once a year. However; once a year, it escalates. So, to prevent an escalation – the white students are penalized by having their free speech restricted (no US flag shirts). My thought would be to simply remove the date reserved for the celebration and thus remove the potential for racial violence. Let them celebrate off campus if they just absolutely have to.

Perhaps the students should wear shirts emblazoned with the French flag on 30 April, which is Camaron Day. The French lost the battle at Camaron, which preceded the battle on the 5th of May, but it is one of the most venerated days in France; especially for the French Foreign Legion.
The Legion celebrates 30 April in the same manner as the US Marines celebrate 10 November each year.
I mean the school officials can’t object to another foreign flag. The curious thing to me is Cinco de Mayo is not even a holiday in Mexico. It is a much bigger deal north of the border; seems like a good mix….The American flag and Cinco de Mayo.
After all…we do celebrate General Pulaski day…or at least in Chicago and New York we do.
