Okay, I was up dealing with a crisis last night, and getting a late start this morning.
I’m unlocking the doors. I haven’t had time to clean the couch off from yesterday, so watch for cockroaches, Zucotti lung, and wayward Supreme Court Justices. Just toss ’em on the floor, and I’ll sweep it all up later.
I’ll go make the tea now…

I found the PDF of the Grand Jury yesterday but didn’t post it. After reading this spin, I changed my mind.
Here is the spin:
Former Penn State assistant coach Jerry Sandusky acknowledged showering and horsing around with young boys, but said he is not a pedophile.
“I say that I am innocent of those charges,” Sandusky, who is charged with sex abuse, said in a phone interview with Bob Costas that aired Monday on NBC.
Sandusky, when asked by Costas if he was a pedophile, responded “No.”
He was also asked if he was sexually attracted to young boys.
“I enjoy being around children,” Sandusky said. “I enjoy their enthusiasm. I just have a good time with them.”
The former defensive coordinator to Joe Paterno and the Nittany Lions was hit with charges earlier this month, including 40 criminal counts of sexually abusing eight boys. Sandusky is currently free on a $100,000 bond and denies any wrongdoing. The allegations date back to 1994, according to a grand jury report.
The report details claims of alleged sexual encounters with boys in Sandusky’s home, hotels and Penn State locker rooms.
“I could say that I have done some of those things. I have horsed around with kids I have showered after workouts. I have hugged them and I have touched their legs without intent of sexual contact.”
And here is the Grand Jury Findings: (Extremely graphic language. Might make anyone with a weak stomach sick.)
This is a scrollable file with 23 pages of testimony.http://www.nytimes.com/interactive/2011/11/06/sports/ncaafootball/20111106-pennstate-document.html

Pyro, from yesterday’s thread:
#28 Pyro: Now that the SCOTUS will hear the obamacare act, dya think that Kagan will recuse herself seeing as how she advocated for the act prior to becoming a justice? Ifn the shoe was on the other foot and it was a conservative agenda item being brought before the court and the newest justice advocated in favor of it prior to being appointed by a conservative president – dya think the libs would be demanding that the justice in question recuse themself?
This is an obvious conflict and all reasonable people should insist that Kagan recuse herself. This is one of those cases where the Rs need to show some spine.
Will it happen? Will the Rs or anybody else insist that Kagan recuse herself from any proceedings having to do with Obamacare?

Lawsuit: LaBelle threw water at tot in NYC lobby
By JENNIFER PELTZ

Buy AP Photo ReprintsNEW YORK (AP) — R&B diva Patti LaBelle hurled curses – and half a bottle of water – at a woman and her 18-month-old daughter after a dust-up over parenting in an apartment building lobby, according to a lawsuit filed Monday and the family’s lawyer.
LaBelle’s publicists and lawyer didn’t immediately respond to Kevin and Roseanna Monk’s lawsuit.
The couple live in a Manhattan building where the Grammy Award-winning singer stayed for a time while appearing in the Broadway musical “Fela!” last fall, said the Monks’ lawyer, Samuel L. Davis.
He said LaBelle chastised Roseanna Monk for letting the toddler take some steps away from the mother as she grappled with some luggage and a car seat in the building’s lobby on the afternoon of Nov. 11, 2010. After Monk scooped up the child and told LaBelle it was none of her business, the singer threw water on them from a bottle she was carrying and then launched into an obscenity-filled tirade, he said.
When the child started wailing, Roseanna Monk made a remark to LaBelle, and the singer charged at her and tried to hit her, Davis said.
The Monks filed a complaint with police; no arrests were made.
The lawsuit, which seeks unspecified damages, comes five months after a West Point cadet sued LaBelle over a Houston airport scuffle with her bodyguards. He said they attacked him for no reason in March 2010. She countersued the cadet, saying he tried to get into her limousine and was drunk and using racial slurs, which he denied.
(These charges were found false)
Davis said Roseanna Monk had asked LaBelle for an apology and a donation to a children’s cancer charity but was rebuffed. The Monks feel “someone’s got to teach her even a diva can’t attack and frighten and assault regular people in the building,” their lawyer said.

re #4 above: I just opened Drudge and saw the banner.
The March 2010 email exchange between Kagan and Tribe raises new questions about whether Kagan must recuse herself from judging cases involving the health-care law that Obama signed–and which became the target of legal challenges–while Kagan was serving as Obama’s solicitor general and was responsible for defending his administration’s positions in court disputes.
According to 28 USC 455, a Supreme Court justice must recuse from “any proceeding in which his impartiality might reasonably be questioned.” The law also says a justice must recuse anytime he has “expressed an opinion concerning the merits of the particular case in controversy” while he “served in governmental employment.”
I think the glop is about to meet the air pusher.

dya think the libs would be demanding that the justice in question recuse themself?
In a short answer, no. You can’t convince a liberal with facts or logic. Showing hypocrisy to a hypocrite will not change their mind. Their only reaction is hatred.

Whether Kagan recuses herself on the Obamacare case is not material to the outcome since either way it takes 5 votes to overturn. However, when she does refuse to recuse herself it will demonstrate what most of us suspected all along – that she is nothing more than another political hack supporting the thesis that the end justifies the means.
She wasn’t appointed because she is a brilliant jurist, and she wasn’t appointed because of her looks, so about the only other option that I can see is that she is a hack.
Hey, are there any left over potato chips under the cushions on that couch?

How come the Hispanics are suing in court about the redistricting of Harris county? They say they want a district that would more favor the election of an Hispanic representative, yet they can’t get out their voters to elect one. A perfect example is the city council seat (District J) drawn specifically for the purpose of electing an Hispanic representative and they failed to get out the vote and elect an Hispanic. Why are they wasting the court’s time if they can’t get the desired results they want via the ballot box?

#9 EG: I really hope that one of the arguments they bring up opposing the act is the waiver on religious grounds for mooooooooooooooslimes; they claim that insurance is a form of gambling and therefore they should not pay – they still get care under the act but they don’t have to pay. That would amount to a codification of a tenent of Sharia Law, the Jizyah tax, and that would violate the establishment clause of the 1st amendment. All of the other waivers constitute an unequal enforcement of the law which violates the 14th amendment.

Because the race-baiting, poverty pimp, plantation overseers like Johnny Mata, insist that only one of the same ethnicity can represent you. That sounds like racism to me.

#13 TT: ON a more serious note, I want the govt to get out of cancer research. Why??
1) Because big organizations are set up to do research with lots of wasteful overhead
2) Funding research will only yield more need for more research, hence the emphasis is wrong.
3) The funding should be reward based, ie, when you can demonstrate a cure or successful treatment, then you get a reward for your efforts in the form of a grant or a bonus from the taxpayers to the successful company.
Funding a cure is way different than funding research. The way it is set up now, there are many more people living off of cancer than dying from it. There is no incentive to find the cure or clear prevention as too many people are making a living from it. Change the incentive structure and you change the behavior and outcome. -

Good morning Hamsters. ‘Twas 71 and moist air at 5:30, dew on the newspaper sleeve so something good landed on our dirt even if it isn’t rain–yet. Crackling on the radio is getting more frequent and a bit more robust. Something is coming for someone. Rye seed on the fill topsoil in the yard is sprouting thanks to our watering it. No sign of anything happening in the pastures yet with only fog and ground mist and a fleeting shower to encourage it.
If Madam Justice Kagan doesn’t recuse herself in the Obamacare case, can you think of any better grounds for impeachment? With a conservative majority House and Senate thanks to the grassroots disgust with all things liberal come January 2013?

Grounds for impeachment are whatever 50% + 1 in the House say it is. Trial, conviction and removal from office takes place in the Senate and unless we have at least 67 strong conservative Rs in the Senate, she will stay. It is highly unlikely that any D would vote to impeach Kagan. Even if she were to rule that everybody had to get 666 tattooed on their foreheads, it is doubtful that any D would vote against her.

I think the glop is about to meet the air pusher.
How so? They’re the highest court in the land. She’ll just say questions about her impartiality are not reasonable so she doesn’t have to recuse herself. The only thing that could possibly be done is if the Senate convicts her and the House impeaches her, based on violations of the Constitution. Never gonna happen.

Article III, Section 1:Article III – The Judicial Branch Note
Section 1 – Judicial powers
The judicial Power of the United States, shall be vested in one supreme Court, and in such inferior Courts as the Congress may from time to time ordain and establish. The Judges, both of the supreme and inferior Courts, shall hold their Offices during good Behavior, and shall, at stated Times, receive for their Services a Compensation which shall not be diminished during their Continuance in Office.
Good behavior or bad for that matter, is whatever 50% +1 in the house say it is.

Like I said, ifn there are not 67 reasonable members of the Senate, she will likely stay. The glop and fan will manifest as even more extreme rancor in DC, (and yes, that is possible). Nothing will get done on anything and the country will descend further down into the abyss. There will be such dysfunction that it will embolden VSRs like ahmajerkweasel to attack Israel, knowing that we will not be able to muster agreement on coming to her defense until it is too late. If Israel gets attacked by the goat rapers in Iran, trust me, the glop will be everywhere and the whole world will suffer for it.

#22 Precedent was set over 200 years ago with Sam Chase. The only way you’ll see any federal judge impeached, much less a SC justice, would be if they were involved in illegal or unethical conduct. There has never been a federal judge impeached based on their judicial rulings.

Once someone starts speaking of themselves in the third person it’s only a matter of time before they crash and burn.
His radio interview reminded me of an old Chris Rock show where he was laughing at people saying Tupac Shakur and Biggie Smalls were assassinated. He said: ” Tupac and Biggie didn’t get assassinated! Abraham Lincoln was assassinated! JFK was assassinated! Martin Luther King was assassinated! Them brothers got shot!”
only he didn’t use the word “brothers”

Consider this from Wendell Cox and City Journal’s Steve Malanga.
And it is just mind-boggling.
Economists usually see business start-ups as the most important long-term source of job growth, and California has long had a reputation for nurturing new companies. Indeed, from 1992 to 2000, California added 777,000 more jobs from start-ups than it lost to closures. But this dynamism vanished in the 2000s. Between 2000 and 2008, California lost 262,000 more jobs from closures than it gained from start-ups.
and,
Another dark sign has been that economic growth in California’s major cities stalled after 2000. Los Angeles and the San Francisco Bay Area had been the engines of California’s economic growth for at least a century. But between 2000 and 2008, California’s two big metropolitan areas produced fewer than 70,000 new jobs — a nearly 95% drop from the 1990s and a mere 6% of job creation in the state. This was a collapse of historic proportions.
Nine years in a combined population (LA & SF metros) of slightly over 20 million people and they produced an average of 7,778 jobs per year from 2000 through 2008.
That is 1 net job for every 2,571 people per year.
Hell, I bet the Greeks had a better rate than that.
The Democrats across the country think this party can go on forever while California is collapsing before their very eyes. Denial is much too mild a word to describe this syndrome.

Dunno, the wind storm that whipped through here took out the power in my neck of the woods at 2 pm. Just got it back up 15 mins ago. There were 3 Centerpoint trucks, a fire truck and a 2-bucket cherry picker working across the street all afternoon. Well, the firemen soon left, but the CP workers were here until dark. Guess the 1″ of rain that came with the storm was worth it. We were already walking around with flashlights when the lights suddenly came on.

Wow, some magnificent views there. Was that the Sahara Desert and the Middle East that was all pinkish? I’d like to see this at a slower speed to try to identify some of the locations. Lightning is interesting seen from above. I saw a show about that, said there is as much electrical discharge shooting up above a big thundercloud as headed to ground. -

It was the US. It was during October breast cancer awareness month. EVERYTHING was freakin’ pink.

On lightening:
Lightning goes up, down and across but the strikes we see hitting the earth are primarily travelling UP.
A thunderstorm is generated by rapid air movements which can be seen in the rapidly rising mass of boiling cloud. This movement generates friction within the air that creates an electrical charge and as the droplets of ice and water fall within the cloud mass they carry negatively charged electrons to the base of the cloud. This causes a build up of negative charge at the base of the cloud and a positive charge at the top of the cloud.
Nature doesn’t particularly care for this and wants things returned to a state of equilibrium and in order to redress the balance lightning jumps between the positive and negatively charged air mass. Most lightning is of this kind and occurs within the cloud formation.
As the negative charge builds at the base of the cloud mass it also seeks to discharge itself by making contact with the positively charged surface of the earth. Current will always take the line of least resistance so it seeks a good conductor such as a tall building or a tree.
The lightening strike begins as a ‘feeler’ or ‘leader’ which makes it’s way towards the surface of the earth in a series of jagged steps, each in the order of 100m in length, each step can change direction which is why lightening can appear to be jagged and can fork in many directions. The series of steps creats a ‘stepped leader’. At the same time as the negatively charged stepped leader is making it’s way down to the ground a positively charged ‘streamer’ begins to make it’s way up from the ground and once the two meet a ‘channel’ is created.
The process of creating a channel is comparatively slow, taking as it does, about a second. The channel acts as a conduit or guide along which the main stroke of lightning travels – this is the lightning we see and hear. It is called the ‘return stroke’ and travels upwards from the earth to the cloud.
The streamer and leader are weak precursor to the main bolt of lightning which delivers in the order of 20 million volts. This is delivered in an instant and heats the surrounding air so vigerously that it causes it to expand faster then the speed of sound – it is this shock wave of ‘sonic boom’ that we hear as thunder.
Sound travels at about one fifth of a mile per second and to detemine how far away the lightening strike was count the seconds and divide by 5. To determine the length of the stroke of lightening count how many seconds the rumble of thunder lasts for and divide by 5.

Yabbut that wasn’t what I meant by electrical discharge going up. There is a relatively newly discovered phenom called sprites that shoot upward from the top of the thundercloud. -

Next week they will compare men and women that wear speedos We will see who is more stupid then.. 😉
Men who show a little skin might be considered sexy and perhaps even a little more sensitive than their clothed counterparts, but they’re also perceived as slightly more stupid too.
That’s according to a study which showed that semi-naked women were perceived in a similar light. Psychologist Kurt Gray, the lead researcher of the study said that while semi-naked men and women might not be perceived as completely stupid, they are attributed “a different kind of mind.”

P.S. Where’s Super Dave lately?Maybe he was Kilt?…Naw, just real busy, I’ve been peeking in a lot but I just haven’t had time to really chime in. Went to the deer lease last week end and didn’t see nuttin’ my Son-in -Law got a 100 LB doe on Friday and a 105 LB spike on Saturday morning. My huntin’ buddy didn’t see anything either. The good news is that the Rut has finally started and the Thanksgiving weekend should be real good, this is the latest start that I’ve seen in east Texas since I’ve been hunting here.

I was thinking about you the other day.
There was last week a caravan of Alabama Power & Light trucks passing through my little town here near the Hudson River. They were among thousands of power company employees from all over the eastern USA who came up to help the folks of New Jersey, Connecticut and New York get their electricity back up and running.

Opening weekend I bagged a small doe because with the drought we didn’t know how bad the hunting would be. Flat Fork creek was dry, along with Cedar creek and Spinny creek (running through our property). We got some rain on the 9 of November and the creeks have a little bit of muddy water in them, not enough to do any good. Anywho, I decided that I process the deer at home, something that I’ve not done in 40 years. I bought a “Gumby Dammit” 4X4 electric meat grinder and when I got back from the lease on Sunday I spent 4 hours cutting/trimming/grinding and vacuum packing the meat,……dang dammit! that is a lot of work! Remember sinew is NOT your friend! I did my best to trim the meat but i got a little lazy and let too much go through and had to clean the grid plate several times. The good news is that I wound up with about 4 Lbs of meat for “Small Back-Up Dawg” which we put in the freezer. We also saved the bones to cook later. 😉

#65 Texpat that’s cool, the power companies always help each other in times of need. When the power company guys from Ohio were fixing the power poles @ the Baybrook Mall I went home and got them some deer summer sausage along with cheese and crackers and told them how glad I was to see them. Two days later I had power, wouldn’t have happened without them fixing the big problem.
That said, my nephew works for the Alabama REA, (not the same as Alabama Power) and he has been to Florida and Mississippi after hurricanes and to Georgia and Kentucky for Ice storms. He and his side-kick get the company credit card and go buy two new Stihl Chain Saws and get in their Ford F-450 Bucket truck and head out. They work 20 hours a day and sleep in their truck and they love it. -

That is still not the sprite form of lightning. Sprites don’t go from the ground up to the cloud. They go up from the top of the cloud. I found something about it in wiki but even this is not quite what I remembered from a few years ago. Don’t remember them being reddish. What I remember looked like light spraying upwards. -

“Bout lightning, electricty always goes form negative to positive, never the other way around. When you have a thunder storm most of the time the clouds are negative and the ground positive but not all the time. 😉

The amazing thing is that the dolt doing the interview expressed surprise that the LaRaza instigator accused the Rs in general of racism. Really?? An organization name THE RACE uses race as a tactic? Why you could have knocked me over with a bull dozer.
