I think this is probably a gross overestimate but, at the same time, the rumors of a Democrat surge in the final days of the campaign are greatly exaggerated:

Michael Barone, co-author of the Almanac of American Politics, says either of the Gallup turnout models would produce “a Republican House majority the likes of which we have not seen since the election cycles of 1946 or even 1928.” Mr. Barone says the historical parallel might no longer be 1994, when the GOP gained 54 House seats, but instead 1894, when Republicans gained more than 100 House seats in the middle of the economic downturn that engulfed Democratic President Grover Cleveland.

Whatever happens it’s gonna be an interesting November.

Your apples and orange comparison is completely irrational.

That tired old retort is getting, well, tired. I readily admit my bias. I think the definition of marriage should remain as it has for milennia in Western society. Apparently most Texans think so as well. The citizens of at least 40 other states think the same way.

And the continued comparison of long since disposed of racial laws isn’t even apples and oranges. It’s apples and asteroids. Those laws restricted certain men and women from participating in marriage like other men and women were allowed to do. It should be telling that those most vociferously opposed to redefining marriage are the very same people you keep erroneously using in your broken analogies.

You want government to define marriage to your liking, and have it in peoples pants and bedrooms

Ya know, repeating invalid statements ad nauseum will never make them valid. What the majority of us want is to stop governments from redefining marriage to the liking of a few whiny folks that somehow won’t feel good about themselves unless everyone else in the world tells them they’re normal. I got news for you – those people will never feel good about themselves until they stop defining their lives as victims. And I really could care less what you or any other two or three or ten consenting adults do in your pants or bedrooms. Just quit demanding that I put a stamp of approval on it.

Interesting how Bob wants to debate the issue rather than address the dichotomy in his characterization, past and present, of his reaction to two votes by the People:

Voting for the traditional definition of marriage = mob rule forcing their will on helpless victims through illegal authoritah.

Voting for legalization of marijuana = citizens exercising their constitutionally-derived authority.

What was that phrase about selective perception bias? And the irony flies right over your head.

When it comes to the right of the People to modify thier government through the ballot box, most of us here are consistent: we assert that it is thier right and that the results should stand.

    Bob, OTOH, does not.

His reaction is entirely dependent on whether he agress with the result.

    Working-class whites shun Dems.

An Associated Press-GfK poll shows whites without four-year college degrees preferring GOP candidates by twice the margin of the last two elections, when Democrats made significant gains in the House and Senate. The poll, conducted last month, found this group favoring GOP hopefuls 58 percent to 36 percent – a whopping 22 percentage-point gap.

In 2008, when Obama won the presidency, they favored GOP congressional candidates by 11 percentage points, according to exit polls of voters. When Democrats won the House and Senate in 2006, the Republican edge was 9 percentage points.

So according to the apparently prevailing logic (or lack thereof) here, if 51% of voters in Texas favored a constitutional amendment legalizing indentured servitude, that would be hunky-dory, and any court that ruled otherwise would be legislating from the bench.

I still don’t get it. But we’re clearly at an impasse on this, and it was unwise for me to respond to that part of Sarge’s #48 yesterday. Neither side of that issue has anything new to say about it.

I’ll remain mute on the topic of government treating all partnerships equally until the next major decision on the case, which is expected December.

As for prop 19, at this point I think freedom is unstoppable. The Drug Warriors and those who benefit from the legitimate money trail associated the silly prohibition of a plant are starting to sound downright silly, and desperate. Good.

But Weinstock thinks there are greater lessons to be learned from all of this: One, the environment plays a greater role in autoimmune disease than genetics, and two, Americans may be going overboard when it comes to hygiene.

A good example of that is Rahm Emanuel running for mayor of Chicago when he probably is not qualified as a resident. They’ll allow him to run though because this was his home state for so long. (Rule of law means nothing) He spent his first day of campaigning with a respectful walk through a local cemetery.

The heart of Walkerโ€™s rationale is that Prop 8 proponents may not even have standing to appeal. But if they donโ€™t have standing to appeal, how did they have a right to intervene as defendants to present the defense of Prop 8? Why didnโ€™t Walker simply enter a stipulated judgment (update: or more properly, as I hope to discuss more fully soon, dismiss plaintiffsโ€™ case) when the state defendants abandoned their duty to defend Prop 8? The obvious reason is that state law recognizes that a propositionโ€™s proponents have authority to defend the proposition, lest government officials subvert the ultimate power that the proposition process places in the people. That authority necessarily must confer standing to appeal an adverse decision. (Update: I hope to amplify this point soon.)

Here is Vaughn’s ruling on the stay.

The relevant portion begins at the bottom of Page 3, but the meat of it begins on Line 19, Page 4:

Still less, it would appear, do private citizens possess authority regarding the issuance of marriage licenses or registration of marriages. While the court has ordered entry of a permanent injunction against proponents, that permanent injunction does not require proponents to refrain from anything, as they are not (and cannot be) responsible for the application or regulation of California marriage law. See Cal Health & Safety Code ยง 102180. The court provided proponents with an opportunity to identify a harm they
would face โ€œif an injunction against Proposition 8 is issued.โ€

Proponents replied that they have an interest in defending Proposition 8 but failed to articulate even one specific harm they may suffer as a consequence of the injunction.

Of course, we’ll ignore the fact that the harm incurred was voiding an election, and leaving appeal of the ruling in the hands of Government officials whom the Judge knows will NOT appeal the ruling.

Voters Are Much Less Optimistic About Black-White Relations.

Perceptions about the state of black-white relations in America have fallen dramatically since the summer of 2009. But voters are still more optimistic about that relationship than they are about relations between whites and Hispanics and between blacks and Hispanics.

A new Rasmussen Reports national telephone survey finds that just 36% of voters now say relations between blacks and whites are getting better. Thatโ€™s down from 62% in July of last year at the height of the controversy involving a black Harvard professor and a white policeman. It seems my erratic cable performance was from my museum model modem. It has been replaced by a sleek, new, improved modem. The cable guy said that it should show an increase in performance, since the old one was showing “noise”.

I HOPE that the CHANGE to my new BLACK modem, which looks HIP and is FRESH will result in IMPROVED PERFORMANCE.

Hmmmm….. not bloody likely, now that I think about it. I’m just hoping it doesn’t crater, like the old one did yesterday.

The jokes just write themselves. Of course, they’ll spin it the other way, such as “his presence is so overpowering, the young ‘uns jes’ couldn’t take it.”

I have a couple of students in my class who think they’re all that and a bag of chips. One in particular thinks she is so cute that she can do whatever she wants. I caught her and her boyfriend passing notes – right in front of me! – during class, so I confiscated them. At checkout, I was at a table at the front of the room, and I snapped to the fact that those notes were at the back of the room with my Bible and other belonings (I had moved to that side of the room so that the “back-seaters” would get the full benefit of my teaching magnificence, since they keep trying to deprive themselves). I turned around and caught Miss Chips digging through my stuff to get her notes back. I was slightly enraged, and told her in no uncertain terms to NEVER touch my personal belongings ever again. Man, if those kids ever thought they could do that, my money’d be gone, my Bible would be torn up, my markers would be missing…and, like I told Miss Chips, she may run across something sensitive about another student.

Note to self: All future confiscated materials go straight into my pockets. I have my eyes on an MP3 player that’s been making a weekly appearance….

So according to the apparently prevailing logic (or lack thereof) here, if 51% of voters in Texas favored a constitutional amendment legalizing indentured servitude, that would be hunky-dory, and any court that ruled otherwise would be legislating from the bench.

You mean if 51% of the legislatures voted in favor of indentured servitude and the governor of Texas signed it into law? That’s quite different than “51% of Texans”. we don’t have a referrendum process; nor do I ever want one.

As for the court part, what authority can you cite that gives the judiciary branch power to overturn a state constitutional amendment in Texas or Caliornia? If you cannot cite proper authority then, well:

When it comes to the right of the People to modify thier government through the ballot box, most of us here are consistent: we assert that it is thier right and that the results should stand.

    Bob, OTOH, does not.

His reaction is entirely dependent on whether he agress with the result.

    (sarge’s #2)

Also, if you cannot cite proper authority to the above question then you empower the courts to govern you life in all aspects. Even inside your pants.

Charlie Crist throws like a girl.

As a former girl, I take umbrage at that comment.

When I was very young, like age six or so, our family used to play the rest of the neighborhood in frequent baseball games. Yes, our family vs. every other kid in the neighborhood. Since I was so young, I was put into the out-outfield, over the neighbor’s driveway. Anything hit out there was an automatic home run. I was the one who had to run down those long hits and throw them back. By the time I was nine, I could out-throw almost every kid my age. When we were in junior high and being scored for the Presidential fitness award, one of the tasks was to throw a softball. They unrolled the measuring tape, and it was very long. When it was my turn, the ball went far past the end of the tape and rolled between the two buildings on the far side of the pavilion area. There were gasps from my classmates. The coach just looked at me and said, “Now you have to go get it.”

Saying Crist throws like a girl offends me. He throws like a monkey.

Reliving those early softball chasing years reminded me of another event…

My oldest sister had married and he joined in one of the neighborhood games. we couldn’t find the softball and so were using a hardball this day. I was in my usual spot in the out-outfield and hadn’t had much business that day. I was daydreaming, watching some birds or something and I suddenly heard everyone screaming something that sounded like my name. I had been looking to my left, and as I turned my head to the right I felt something whiz by head and barely graze the tip of my ear. I just kept on turning and chased the ball down and threw it back.

It didn’t realize me until later that had I not turned my head, the hardball, which was traveling at a high rate of speed, would have hit my skull just behind my ear. Then I realized what the looks on the faces of my family and friends meant. There was probably a number of pairs of underwear that needed to be changed. And one tired guardian angel!

I think there is something biological involved in the “throws like a girl” thing. There are gender differences in what our bodies are good at and how they are put together. Thus it can be hard if not impossible for many girls to make the motions that equal good pitching. Throwing to base is a bit different and perhaps easier for girls like young TT to learn how to be good at. I would not doubt for a second that she was very good!

Yes that’s him, should have been more specific. Doc has had him on Beta Blockers which keeps his heart rate down to like 50 BPM, even so, he’s still had a couple of incidents that went away quickly. There’s just something not right about keeping an active 19 yr old’s heart rate down that low.

It is a non-invasive procedure which is fairly safe, although the first time they did lose him on the table a couple of times-in a controlled environment the doc said ๐Ÿ˜ฏ , but it was a difficult case. The second one was very easy where one of the pathways had healed itself but was weak, hopefully that will be the case this time.
