    This is a good thing. They should win this one.

    The University of Texas-Austin is not only chilling speech by threatening to punish students for “incivility,” “rude” and “insensitive” comments, and other undefined behaviors.

    It’s facilitating harassment against groups who are frequently targeted as rude and insensitive for simply expressing their political opinions, especially the Young Conservatives of Texas, according to a lawsuit filed against the public university Thursday.

    The nonprofit membership association Speech First targeted several policies and practices at UT that allegedly run afoul of the First and Fourteenth amendments.

    It’s representing three pseudonymous UT students with unpopular views on campus who are censoring themselves to avoid investigation and punishment for violating vague or undefined speech rules: a “Tea Party conservative,” a libertarian and a social conservative.

    In addition to UT President Greg Fenves, they also named in the suit the 14 members of the “Climate Response Team and all members of the Board of Regents”. Now all these individuals have to be served with notice and can’t claim to not know about it.

    Foundation for Individual Rights in Education (FIRE) is another free speech outfit that has been around for a while and has reviewed the speech codes at virtually every college in America. They are also stepping in on some of these fake rape cases being adjudicated by Title IX officers at schools where the defendant is not allowed to present a defense or even face his accuser and is ruined for life when he is kicked out of school. It’s good to support all organization of this type as the Dems and the media seek to disallow speech that they don’t want to hear.

    I’m gonna go back to Obamacare for a minute. The judge’s opinion in that case quotes Chief Justice Roberts and other members of the court who basically said (1) the mandate is an integral part of the Obamacare and cannot be severed from the rest of the statute; (2) the mandate is unconstitutional under the Commerce clause; but (3) the mandate is a tax which Congress is authorized by the Constitution to levy. His logic is that without the tax, (1) the mandate is not authorized by the Commerce clause and is unconstitutional, (2) the mandate cannot be severed from the remainder of the statute; thus (3) O’care is unconstitutional using the very words that Roberts dreamed up to keep it alive in the first place. This is going to be a fun fight to watch.

    The ruling by the judge in Fort Worth is a real keeper and I read the first few pages.

    However, this district court ruling is “declaratory” and not “injunctive”. No one is compelled by the court to take or stop any action. As opposed to the tyrannical, egotistic dicta over the last 2 years handed out by Leftwing jurists undermining the current president.

    If, in the interest of caution, the Fort Worth judge is asked by the defendants to grant a stay for the duration of the appeal, it’s almost automatic he would grant it. I don’t see this making it past the Fifth Circuit, but who knows ?

    The other wild card is the Trump administration taking this judgement and running with it by refusing to enforce the ACA (whatever exists still enforceable). I don’t see this happening – it would be chaotic, a PR nightmare and political suicide. This is overturning precedent, invalidating major legislation and will get full review before it can have any legal ramifications.

    I suspect Judge O’Connor knows his judgment will go nowhere, but he seized the opportunity to get his reasoning and arguments into the top tier gladiator venue of political and judicial debate. Very smooth move, Your Honor. This ruling will be cited for decades to come.

    Having said all that, I agree wholeheartedly with U.S. District Judge Reed O’Connor. In fact, he should be on the short list for Ginsburg’s seat.

    It would be interesting if the Fifth Circuit just punts this appeal to SCOTUS. It seems to me they can’t weasel out of confronting it because this is a huge lawsuit by 19 state governments suing the US government and California.

    On August 21, 2016, O’Connor made a ruling against the Obama administration dealing with the government’s interpretation of Title IX rules. The guidance from the White House was issued in May 2016, and addresses the Title IX requirement that schools receiving federal funding not discriminate against students on the basis of sex. O’Connor ruled that the new guidelines did not receive proper notice and comment prior to publication, and that Title IX and its implementing regulation are “not ambiguous” as to the “plain meaning of the term sex as used”. As such, he issued a nationwide injunction preventing them from being enforced with respect to students’ access to “intimate facilities.”[3]

    On December 31, 2016, in a separate case, O’Connor issued a preliminary injunction against enforcement of the Obama administration’s regulations implementing Section 1557 of the Affordable Care Act (prohibiting sex discrimination in federally funded health programs) as a likely violation of the Religious Freedom Restoration Act and what he said was an improper inclusion of gender identity discrimination.[4]

    On October 5, 2018, O’Connor ruled that the Indian Child Welfare Act was unconstitutional.[5]

    Obama care ruling:
    I’ve not seen the exploding heads on TV yet, so I have to assume that the media and the Dems are huddling over the weekend to get their story straight and will come out blazing on Monday. I’m sure it will be the usual about people left to die in the streets, etc. Now guess what – we still have a Rep House and Senate for 2 more weeks. How about they get their acts together, produce a replacement bill, and get it done before the first of the year. That’s the reason the judge did not enjoin – to prevent the chaos that can be avoided by having a legislated substitute in place.

    As it stands, Roberts has to denounce his own words in order to overturn this judge. So, is he willing to do that just to save O’care whose political sponsors have moved on, or will he stand up and say he was right all along and agree with the opinion. Smart money says he won’t stand up for O’care again after the damage his reputation has suffered from the first time around. Certainly not implying that Roberts may be a honorable person or anything – no, that he will vote in his own self-interest like any other weasel politician. I can’t wait for the howling, moaning, and gnashing of teeth to begin on the media though.

    Daughter called last night and was about to have her husband’s Federal Christmas party, it seems that they can’t have it at work? There are about thirty of them and they raise money, through the year to rent a venue but this year the $500+ isn’t going to be enough. Last year they spent $500 on a small place they could afford but this year the same place is $1500, thanks to the oil boom….AND, that is a good thing. They wanted daughter to host the party since she had the biggest house except for the big boss but his house is too far away. She said that since it was still, no wind, they were going to open the back door and use two of those big propane heaters on the patio, they’ve done this before and their fenced in back yard is not very deep so it heats up pretty good. They have an oversized lot (whatever that is) and their side yard is huge but not the back.
    I hope she’ll call later and give me a report.

    Daughter also said that her Toys for Tots drive was a resounding success. Her boss from the Woodlands was here last week and took some pictures of the toys and some of the crew to put in the company newsletter. She told daughter, “you know that this makes you look pretty good”.
    That’s my girl. 😀
    Oh. and I picked out 4 of the pictures she sent me and put them in word so they’d all be on one page. Looking at the picture, starting from the upper left, it would be a panorama shot if they pictures were lined up. It starts at the left window and goes to the one on the right, then along that wall. The right side of the first picture blends into the left side of the next one and so on.

    The panel investigating the Florida high school massacre recommended Wednesday that teachers who volunteer and undergo extensive background checks and training be allowed to carry concealed guns on campus to stop future shootings.

    The Marjory Stoneman Douglas High School Public Safety Commission voted 13-1 to recommend the Legislature allow the arming of teachers, saying it’s not enough to have one or two police officers or armed guards on campus. Florida law adopted after the Feb. 14 shooting that left 17 dead allows districts to arm non-teaching staff members such as principals, librarians and custodians — 13 of the 67 districts do, mostly in rural parts of the state.

    Pinellas County Sheriff Bob Gualtieri, the commission’s chairman, pushed the measure at the Tallahassee meeting. He said most deaths in school shootings happen within the first few minutes, before officers on and off campus can respond. He said suspect Nikolas Cruz stopped to reload his AR-15 semi-automatic rifle five times, all of which would have been opportunities for an armed teacher to shoot him.

    South Texas School of Law has always been nationally famous for producing the top litigators in the country. They’ve been champions or at the top level of Moot Court competitions for decades against schools like Harvard, Yale, Princeton and Stanford. They may not produce a lot of judges, but they will whoop your a$$ in court.

    And speaking of Sister, they opened their new store on January second, this year and 2018 has been their best year yet. They not only moved the store, but moved to a different town. They bought an old automobile dealership building, downtown, in a small town that would remind you of old town Spring. The town is trying to revitalize the old part since all the businesses moved out to the bypass.

People in DC all have the good on each other, but they hold the stories in reserve until they might need them or where they can do the most serious damage.     I just got back from a service project with our church confirmation class. We served food out the St. Vincent de Paul food pantry. It was actually kinda fun. We served over 300 families with food boxes, and they provided 50 clothing outfits. We had a lot of volunteers, so the work wasn’t hard.

    As for the pictures, Ferd is the flying Cupid-like figure. He’s hanging suspended from the upstairs balcony railing. Bow in one hand and an arrow on the other. Mortimer has the knife and fork. He sits on my kitchen bar.

    They are both wedding anniversary gifts, at my request. I love stuff that makes me smile.

    Our abbreviated Christmas decorations this year.

    Side Bar; In the 43 years that my wife and I have been married, there was only one year that we didn’t have a tree and that was 1978. We had just moved from Brunswick to Savannah Georgia, things were scattered about and we planned to have Christmas in Alabama with the family. This year, we got a late start and are heading to Alabama for Christmas and decided to forget the tree.

    So, last Sunday, I was at Kroger’s and saw this cute little, live tree for $20 and I almost bought it but I thought that since my wife was planning on leaving for Alabama today, it would be a waste. Then on Monday, I get home from work and there is the dang tree! I tell you she can read my mind,… She had it all decorated, along with the mantle, with a few presents under it. Come to find out, she wanted to get some live garland, so she went to the family owned lot, where we have been buying trees for the 36 years we’ve been here and saw a little tree just like the one at Kroger’s so she got it and some garland cut from juniper that smells real good. I’ll add that this is the smallest tree ever, we got a 4 footer last year and it was small but this one is tiny.

    BTW; When we get to the old homeplace, we’ll cut down a “Charley Brown Tree” like we always do.

    Both of my nephews are Eagle Scouts and my brother keeps up with the BSA. He tells me when they let the homos in the Mormons left to start their own organization. They were one of the largest supporters/groups left.

Then matching up yards, pictures, names, addresses and more photos. Probably find some illegal pets in there to say nothing of the back yards with lime green or pink paint on the fences or some off color light bulbs. Do you have to give your email address and password or your mother’s maiden name to claim your prize?

    I’m sensing a great HOA spy duck exercise here. Next thing you know Phil will be downloading all those photos, names, and addresses from the internet and selling them to Amazon or Google so they can target more ads. Notice to home owners – don’t do it, it’s a trick designed to get you to divulge information for evil intent. BTW, do those rules say anything about limiting the number of cats you can have?

    Today our Troop gave back to our charter organization by volunteering to help at the Church’s Giving Tree. The church adopted close to 100 families. The parents walk away with some items, the kids end up with some presents, and there is some good fellowship too with a chance to spread the real meaning of Christmas.

    This evening my youngest boy crossed over from Cub Scouts into Boy Scouts. My oldest boy is one merit badge and an Eagle project away from earning Eagle rank. With all of the PC crap going on, I sometimes wonder if I can survive another 5 years of Scouting. What keeps me going is that I see a whole lot more positive coming out of our unit and Sam Houston Area Council than the negative coming down from national. I have watched in amazement as my quiet and reserved boy has developed the ability to speak in public and to lead small groups of his peers effectively and efficiently.

    I was a little shocked that abuse cases within BSA were prevalent enough to cause financial woes. They are also being sued by the Girl Scouts. I received one email this week from National that said the news would break the next day. Apparently they have been paying for a lifetime of counseling at a provider of the victim’s choice.

    The next day I received an email from our local Sam Houston Area Council stating they are still in the black. I never realized how financially independent the Councils are from National. I was glad to learn that since I was about to drop a large charitable donation to Friends of Scouting into the mail. Friends of Scouting stays 100% here in the greater Houston area.

    Morning gang. Cool 36 degrees out here this morning with some clouds but no wind just yet. Another nice day in store it would seem. The effects of Friday’s football loss seem to be wearing off, and the positives of a team ranked 5th in its district pre-season making it to the state semi-finals seem to be sinking in. This team was not ranked in the top 10 state wide 2/3 of the way through the season since we live in a media desert out here and don’t get much press coverage. Trying to decide on my holiday travel plans, and it looks like the weather might be cooperative this year. It’s about getting that time I guess where holiday plans should be made. Here’s hoping that you all have a great day.

    I raked about half the front yard yesterday. It was slow going because I kept uncovering pecans; gathered another basket full.I dragged several tarp loads of leaves to my compost piles.

    I had to stop before I overdid my back. I had to soak in Epsom salts and take Aleve, then hang. I want to get out in this lovely weather again today…but I know I have a tendency to not stop when I need to, so I’ll restrict my activities to indoor chores today. Dangit.

    My body is feeling the effects of yesterday’s activities.

    Coming home I saw two early 60’s Corvair’s, one was a station wagon, I don’t know if I ever saw one before. I remember the vans and trucks that copied the VW van but not a station wagon. They were both rough and somewhat rusty, but the bodies looked straight….Oh and they weren’t smoking. 😀

    Finally got my Santa collection all displayed. MIL’s cabinet has a shelving system that uses a notched, zig-zag rail on the vertical corners. There are small shims with both ends cut at angles that fit into those rails, kind of like a ratchet system but static. Think of stairs and treads and you’ll be close. My original display wasn’t going to work because she had stapled some of those shim pieces into place, for what reason I’ll never know. That meant that I couldn’t adjust those shelves to a spacing that would accommodate my taller Santa figurines.

    I wasn’t pulling out those staples without Hubby being here. The last thing I want is for him to blame me for wood damage to his mother’s memory, which is what that cabinet is. He pulled out the shims and staples, and I’ve managed to get my Santa Clauses all on display.

    On to wrapping presents.

    I haven’t been watching the Sunday talking heads, but did catch George Steponallofus today. His intro made it sound like Trump was roadkill already, that all that was left was procedure.

    Then Giulani came on for his interview. He didn’t just own Steponallofus, he ate his lunch. He didn’t just eat his lunch, he beat the crap out of him and took the rest of the week’s lunch money. GS tried to spin it later as if Giulani hadn’t made his points (and impaled GS on them).

    Oh, and GS also thought that the “invite the press moment” backfired on Trump and made him look bad.

    Libs and conservatives are definitely wired differently.

    So, do any of y’all know how things works over yonder? Every now and then, someone sees/likes a post and or comments. This afternoon a good friend of mine, the best man at my wedding, commented on the Free Range Pig that I murdered last year. I didn’t think much about it since this happens often, but then my cousin in NC and a friend in Florida both commented on it. So, I assume it dropped back in the line-up with out me seeing it? I say that because, memories from pervious years pop up but I have to post them it doesn’t happen automatically.

    #81 #83 I watched some of all three of the LSM shows and the left is not only unhinged but totally delusional.
    They just keep hoping. Oh and I saw the Trump slap down of Pelosi and that used car salesman from New York and it was BRUTAL!! He wiped the floor with them and made them look like what they are,….STUPID!!!
    God Bless Trump! We’ve been needing a real leader for a while.

    Wow, I am tard. Spent 2 hrs 15 mins standing up at our Santa event. One re-tard couple showed up with a kid 15 mins after the announced end of the event and were surprised that it was over. But our fab Santa was just driving away and saw these morons and pulled over and got out. Of his car. No sleigh involved. Put his Santa hat back on, got out and talked to the kid. Santa for the win!!!
