    Woke up to some overcast this morning and a little misty rain from time to time. Radar shows large area of green to the south, so hopefully it will stay gloomy all day and bless us with a little more moisture. I was planning to mow this morning, but I can always put that off until it dries out. These fall like temps don’t hurt either.

    The reason Mayberry was so peaceful and quiet was because nobody was married. Andy, Aunt Bea, Barney, Floyd, Howard, Goober, Gomer, Sam, Earnest T Bass, Helen, Thelma Lou, Clara and, of course, Opie were all single. The only married person was Otis, and he stayed drunk.

    American contractors in Afghanistan will probably be sitting ducks, if the Taliban get much stronger over there. While this headline says “hasn’t shared”, those speaking out make it clear there is no escape plan. Lurch Kerry isn’t going to be one whit better than Cankles Clinton, when TSHTF.

    The lede:

    Greedy super PACs drained the movement with endless pleas for money to support “conservative” candidates—while instead using the money to enrich themselves. I should know. I worked for one of them…

    What began as an organic, policy-driven grass-roots movement was drained of its vitality and resources by national political action committees that dunned the movement’s true believers endlessly for money to support its candidates and causes. The PACs used that money first to enrich themselves and their vendors and then deployed most of the rest to search for more “prospects.” In Tea Party world, that meant mostly older, technologically unsavvy people willing to divulge personal information through “petitions”—which only made them prey to further attempts to lighten their wallets for what they believed was a good cause. While the solicitations continue, the audience has greatly diminished because of a lack of policy results and changing political winds.

    #13 TP: That confirms my suspicions. I am glad that I never wasted the money. The petition thing is also something that I have almost always avoided. Something about both of those just did not sit right with me.
    I wonder how the NRA fares under this scrutiny?

    The 2016 Bulwer-Lytton Fiction Contest winners have been announced.

    The winner of this year’s Bulwer-Lytton Fiction Contest, the XXXIVth Lyttoniad, is William “Barry” Brockett of Tallahassee, Florida, a 55-year-old building contractor who has specialized in additions, home makeovers, and bathroom/kitchen remodels for about twenty years. His particular enjoyment is reading, with true crime and the “hardboiled” genre being his favorites, hence his winning entry.

    “The organic, policy-driven grass-roots movement” is still alive. The individuals and their beliefs are still around and active. The little fiefdoms and clubs are dead. Besides that the “Tea Party” movement is nothing more the disenfranchised conservatives/Republican base voters that have decided to stop supporting the “R” party. They were not/are not some new block of voters, they have always been there, they just decided to divorce themselves form the establishment.

    Pretty much confirms my suspicion that Trump is using their mailing list and market research, and plans to deliver the same knock ’em dead service.
    Sean Hannity is the poster boy for this kind of self serving hucksterism. He’s always been more interested in his ratings than anything else. I stopped listening to him when he started saying “I’m dedicating my efforts to making John Boehner Speaker of the House and won’t rest until that happens.
    Now he’s desperately trying to avoid being blamed for one of those responsible for making Hillary President.
    The “Conservative Media” has become a scam, a joke, an impediment to Conservatism.

    Question: Can I file a mechanic’s lien for work done at a house, even if we did not improve the property or install materials?
    We have a customer that had us do some investigative digging to locate a sewer line, but we have not installed or removed anything. We have not “improved the property” as the standard lien letter forms say. We just dug a hole and looked inside.

    I think I found the answer. A legal website on liens says “for labor done or material furnished,” so I guess I just have to change the lien affidavit thusly.

    SUBCHAPTER A. GENERAL PROVISIONS

    This is surprisingly clear and well-written and free of legalese. It appears to me you are well within the law in filing a lien on this property. Photos, witness affidavits, documentation are things you should also have.

    Once you put the spade in the ground, it was labor and it was an improvement – even if you found nothing, you eliminated that as the trouble spot. Travel to and fro and time are also labor and related expense. Do not adjust the form – make the defendant claim that whatever it says is not true. Always be on the offensive. File the lien first, then to small claims court.

    I talked to the customer this morning, and he swears he’s getting funded on Wednesday. I’m sending a demand letter, that I’ll pick up the check in person if necessary, by Friday, else we go to small claims.
    It’s been our experience that the judge will then add late payment penalties as per our proposal, then we can file a lien using that judgment.
    No guesswork there.

    OFFICIALS in the German port of Hamburg are monitoring reports that Muslims posing as ‘Sharia Police’ are carrying out patrols in the city.
    Eyewitnesses reported seeing three people wearing burkas and black gloves driving around Hamburg’s Wandsbek district in a black VW.
    They said a sticker with an Islamic logo and the words Sharia Police was fastened to the car’s bonnet.

    Do you r e a l l y want to do a mechanics lien. Do it yourself forms cost upwards of $150.00. Then you have filing fees. and then you have to wait for the property to be sold to collect.
    Small claims court is cheaper to file and you get your money quicker.
    The real question you should ask is
    How much am I owed and what are the costs to file a lien, sue in court or whatever. Can I recover my filing fees in the settlements etc.
    Seems to me small claims court is your best bet. Your milage may vary.

    I’m more than willing to be corrected, but just exactly what does a small-claims/JP judgement get you? A piece of paper?
    Give me an instance where you have successfully collected a judgement from a JP Court from someone fully determined to avoid payment or fully judgement-proof.
    Whereas I can promise you, when a pending land sale is tied up with a lien, people will do anything to free it up. Even if is your heirs that end up collecting.

    Good late afternoon Hamsters. Spouse was monopolizing the computer I use for his telecommuting today so I’m checking in late.
    We’ve managed to attract 1.3″ into our rain gauge since the monster system rolled into our area yesterday. Yea. Would be nice if more shows up in like manner, steady rain minus lightning bolts, no gusty winds, staying around hours at a time, stuff like that for a couple of days. Oh and most important, keeping the temp in the 70s, preferably the low 70s. 🙂
    The Tea Party Movement is not dead at all, but of course Politico would dearly love to believe it and so welcomed that expose article on opportunist PAC runners. We know the GOPe publishes their stuff with Politico, so the conservative bona fides of Paul H. Jossey as author could raise some suspicions. Is he a plant?
    Not only is the movement not dead, it is now mainstream and populated with many more and much more knowledgeable folk than when it began in 2009. If it was dead, how come Dinesh D’Sousa’s Hillary’s America is drawing large crowds countrywide?
    So the charlatans raising funds for themselves are having a harder time, good. The petition game is useless and likely ends up in File 13 as soon as it reaches a government inbox. Individual letters and emails are much more effective. Direct donations to candidate campaigns are smart moves.
    Now we breathlessly await Politico’s expose of the Clinton Foundation, don’t we?

    I have been through small claims 3 times and 3 times I got my money and court costs back. The other guys fought like crazy. I paper worked them to death. Preparation my friend. Preparation.

    I have never believed the Tea Party ideals have died or faded away. And because I post an article never means I completely agree with every point proffered.
    I do believe there is quite a bit of truth and lessons to be learned in Jossey’s article. There were many charlatans leaping on the righteous outrage gravy train. Does anybody remember the Tea Party Express from the early days ? It was a couple of old Republican fundraisers who saw an opportunity so they bought a big expensive RV and began touring the country organizing rallies, collecting names and personal info at events they organized. Pure crap from day one. They collected millions and paid their own direct mail company millions to keep cranking out the cards and letters.
    The truth in Jossey’s writing is many PACs and other organizations got many people’s hopes up that something would be done when, in fact, they were siphoning off the money and dreams of countless sincere, dedicated Americans. I wish every area and region of the country was as strong and devoted to the Tea Party initiative as the folks in Fort Bend County, but I think the momentum did fizzle out in a number of the more marginally conservative areas of the country.

    Sweetie is live streaming the candle light stuff at Graceland. Memphis BLM has been very active for several weeks and of course a bunch of old white women gathering up in one spot is just too inviting to leave alone so they got a protest up.
    Memphis PD is geared for it and has a section for them cordoned off, way off. They doing they chants they been handed out but every once in a while they holler they can’t see Elvis from here or they just came to see Elvis. Pretty funny actually. 😀

    There were lots of Tea Party groups co-opted by the GOP, and way too many of those groups thought they were in the tent finally. Many like Fishy saw it for what it was. The people are still there with the same agenda but the group didn’t work out.

    If the house is being built on an interim construction loan pending completion for permanent financing and you get your lien in before the mortgage closing, they would have to pay you to get the closing done with title insurance.

    I remember back in the 90s, Shannon had an elderly contractor friend who had filed a lien on a major renovation in a swanky Houston neighborhood because the homeowner refused to pay the final bill.
    One day, so many years later the contractor had forgotten about it, he gets a call out of blue from some title company saying they have a check for 20 or 25 grand waiting at their office and they need him to come down and sign a release of lien because the customer was trying close on a sale of the home.
    So he went out and bought a new truck. Almost found money.

    When the builder is still drawing on an interim construction loan, he is most able to take care of this. File the lien. Everyone on that job will know about it in short order, and if there are other unpaid creditors/suppliers, they will jump in there and do the same, knowing that their position in line may determine their recovery potential. You should be take care of pretty quickly.

    And my point is the people are there. In a sense the Tea Party is alive and well. It has just returned to its original incarnation.
    Speaking of carpet bagging politicians D_n Patrick was one of the worst. That sorry dog dissed the movement till he found a way to usurp it for himself. And boy did he hitch his wagon and jump into the drivers seat. He set up two or three web pages which you can no longer find calling for “R”s to sign on to his “mandate”.

    One of the goofiest stories I’ve heard in a long time. Seems the NYC architect son of Dominique De Menil is building a small artist colony in Acres Homes. Unless the “enclave” has an electrified fence around those 18 homes, I don’t see how it will be feasible.
