David Harsanyi at The Federalist repairs the lies of the Left..

If you find yourself in a debate over the Second Amendment, sooner or later someone is going to let you know that Burger believed an individual right to gun ownership was one of the “greatest pieces of fraud” perpetrated on the American people. Burger’s line is ubiquitous—it can be found in The New Yorker, Slate, Politico, NPR*, every major newspaper, and in every anti-gun columnist’s pieces.

The first problem with the popular online iteration of the quote is that it’s actually cobbled together from three separate sources to give it more impact. Don’t get me wrong: Burger is mistaken in all instances, but he is mistaken in different contexts.

Here is the meme with the constitutionally incorrect Burger quotes comprised of three disjointed quotes all from non-judicial venues:

The second problem is that the quote often reads as if Burger—the “conservative” who voted with the majority in Roe v. Wade—offered this argument as a member of the Supreme Court. No high-court decision has ever defined the Second Amendment as anything but an individual right. And Burger never uttered a word about the Second Amendment while sitting on the court. For that matter, he never rendered a gun decision on any court, nor ever wrote a legal paper on the issue. And it shows.

The Second Amendment explicitly mentions “the right of the people” — people who generally used their own weapons as militiamen — just as it does elsewhere in the Bill of Rights when protecting individual rights. Many colonies enshrined the individual right to bear arms in their constitutions before the Bill of Rights was even written, most of them in much more explicit terms. No state defined it as a collective right. Some Federalists argued that special protections in the Bill of Rights were unnecessary because there were so many guns in private hands that it was unimaginable any tyrannical army could ever be more powerful than the public.

*Not only does the Left not know how to meme, they don’t even know how to recognize a valid and truthful meme.

    Morning gang.  Looking like another nice day today before storms and wind return for tomorrow.  All this turmoil in the atmosphere usually signals the coming of spring, and I for one am ready for spring to arrive in all its glory.  TOK is closed indefinitely (probably 3 weeks or so if not permanently), so I’ll go back and try Mama J’s to see if they will still welcome me back in.  Should be nice and warm so I’ll get outside and do a little more plant work.  My yard is pretty well full of weeds, but none of the grass is greening up yet, so I don’t want to mow it short until I see some green grass showing up.  The greenhouse takes up a portion of my small garden, and the plan is to eventually take it down and plant stuff in the area that it is sitting on.  It’s simply too early to try to put tomatoes in, and they are not big enough yet anyway, so I just need to hold my horses and give it more time.

    A couple of months ago, I got a new smart phone and have been trying to figure out what to do with the old one.  The original smart phone that I got when they did away with 3G was the cheapest refurb that I could find, and it simply did not have enough internal memory to do the things it needed to do.  I got everything transferred over to the new one, which is the second cheapest refurb that I could find, but the original phone still works just fine except for making phone calls.  It still connects to my network and the apps all seem to work, so I’m trying to figure out how best to incorporate into my system.  I’ve got plenty of remote controls for various devices, don’t really have anything that the Echo or the Kindle can’t control or do, etc.  Eventually I’ll find some single use purpose for it I guess, so I’m not going to just throw it away.

    I have an appointment later this month, we’ll see what they say.  I may wean myself off of the painkillers the week before, so they can see what I’m dealing with.

    Then, as Lightfoot foots it out of office, Michigan State U. ends its vaccine mandate.  Coincidence?  Related, the LA Board of Supervisors will end its emergency status on March 31st.

    Next up, Mr. C. discusses the predicted downfall of the Chinese economy due to the draconian zero Covid behavior, and compared it to the “improving under Biden” economy.

    I hate to be “that guy,” but the US’s economic forecasts are all downwards. Meanwhile, WSJ reported “economic activity in China expanded sharply for a second straight month.” Sharply. The manufacturing, exports, services, and construction sectors are all headed up, possibly even exceeding a previous optimistic 6% growth target.

    The Journal credited China’s turnaround to abandoning its awful Covid policies:

    The [report] will be a welcome relief for China’s top leaders … helping to turn the spotlight on economic growth and away from the damage caused by their zero-Covid policies. China’s economy grew [only] 3% in 2022, one of the slowest rates in decades, as pandemic controls shut factories, depressed home sales and crushed consumer spending.

    So … a bad covid-zero economy “slowed” China’s growth to 3%, and a good open economy sees growth exceeding 6%. Got that? By contrast, on February 15th, the Conference Board published its US economic forecast, which predicted that real GDP growth will slow to 0.3% in 2023, and then ‘rebound’ to 1.6% in 2024.

    That’s a Joe Biden economy for you. We’re doing a fraction — ten percent! — of what China did at its worst — under covid-zero lockdown! — which was considered embarrassingly-low economic performance even by the COMMUNIST PARTY.

    How about Russia? … the International Monetary Fund predicted that, after taking a hit from US sanctions in 2022, Russia’s GDP will “rebound slightly” in 2023 to 0.3% growth, and then in 2024, the Russian economy is predicted to grow by 2.1%.

    So let me get this straight. Biden’s awesome economy, after getting his gigantic “inflation act” passed, is sputtering at 0.3% — the exact same level as the most heavily-sanctioned country in the world, which is also currently dumping everything it owns into a losing Proxy War,…

    And then, EVEN UNDER SANCTION, and gushing men and matériel into a losing Proxy War for a whole ‘nother year, the IMF still predicts Russia’s economy will perform about 50% better next year than the United States’ economy, even though we were the SANCTIONING COUNTRY to start with? Are you kidding me, Joe Biden?

    It seems like covid and the proxy war have been pretty good for Russia and China, but awful for the United States. We’re running a distant third.

    BTW; I like the OC topic and always remember that the first 10 amendments were added to the Constitution before it was ratified without them there would have been a Constitution of the United States. And most importantly the first 10 amendments were there to protect the people for the Government not the other way around. This is what the left doesn’t want you to know or sadly some of them don’t know.

    On Friday, Hammond, Indiana native and former New York Mets pitching prospect Matt Pobereyko, 31, died suddenly and unexpectedly of a heart attack AT HOME near Chicago.

    Matt was relaxing in his apartment in a west Chicagoland suburb when he apparently collapsed, and was discovered by his girlfriend later on Friday.

    The cause of death has not been released, of course.

     Local ABC 11 WTVD-Raleigh ran a story Friday headlined, “NCSU Student Found Dead At Private Residence Identified; Investigation Continues.” Check this out: it’s the NINTH sudden and unexpected student death at NC State THIS SEMESTER:

    At least some of the deaths have been suicides. As far as I can tell — and information is tough to come by — five of the dead young people have been ‘ruled’ as self-inflicted. But NC State normally averages three student suicides per YEAR.

    Fortunately, NC State is ON IT. According to local CBS 17, university officials have announced a new DEI plan to help cheer up the kids: “Integrating campus-level diversity, equity, inclusion and mental health planning to ensure fostering a sense of belonging for all students.” So, that ought to do it. Don’t worry, parents of NC State kids. They’re going to give them some more guilt, I mean awareness, I mean diversity training.

    It seems a lawmaker has put forth a bill that would cancel any political party that ever promoted slavery.  Guess what?  It wasn’t the Republicans, despite what you may have heard.

    Yesterday, Florida Republican State Senator Blaise Ingoglia filed SB 1248, titled “Political Parties (The Ultimate Cancel Act).” If passed, the law would immediately de-certify any political party that previously advocated for slavery or involuntary servitude in their party platform….

    Guess what? Coincidentally, the Democrat Party has adopted pro-slavery positions into its platform, not once, but FOUR TIMES:… right up until Republican President Abraham Lincoln made slavery illegal.

    Bwahahahahaha! Oh my gosh! It’s brilliant! Kick them while they’re down! Hoist them on their own petard! And so forth! Imagine the rhetorical spaghetti democrats will need to defeat this bill. Will corporate media be able to leave this story alone? What with the mean Republicans viciously attacking their beloved democrats? I sure hope it won’t. This story needs a lot of airtime.

    This is delicious.  It’s like dropping a cat with buttered toast strapped to its back.  The politically correct won’t know which side of this issue to land on.

    Newsweek reported the State Democrat Party’s response:

    “Presenting a bill that would disenfranchise 5 million voters is both unconstitutional and unserious. Under Ron DeSantis, Senator Ingoglia is using his office to push bills that are nothing more than publicity stunts instead of focusing on the issues that matter most to Floridians, such as reforming property insurance, addressing housing affordability, and combating climate change,” the spokesperson wrote.

    I am totally fascinated by the pandemic’s historic political inversion. First, vaccine mandates caused the Republican Party to become the party of ordinary workers’ rights and personal medical autonomy, with the democrats supporting big business, “your-body-government’s-choice,” and crying about over-regulation. Now the democrats have snatched up the flag supporting mega-corporations, which used to be the Republican Party’s exclusive domain, and the Republicans have now officially become the populist party.

    It’s hard to imagine what, besides THIS pandemic, could have possibly effectuated this kind of profound political reversal. Personally, I consider these developments to be fantastic shifts that will bear fruit for generations.

    At the risk of oversimplifying, GJT, you have two choices:

    1) Traditional Medicare and a Supplement (for which you pay extra)

    or

    2) An Advantage Plan (which is like an HMO where you see only their doctors and go to their facilities). They usually offer some “free” enticements like crappy dental and vision plans.

    I chose the Traditional/ Supplement route. Because if I want to see a witch doctor in Waxahachie, I can.

    I turn 68 this year. My Supplement will cost me $198 a month. There’s a small deductible.

    My $40,000 heart catheterization (angiogram) didn’t cost me one thin dime.

    And with the Traditional / Supplement route, my doctors and I don’t have to go through a nightmare “Approval Process” every time one of my doctors wants to do something.

    Agreed.

    In addition to Medicare and a Supplemental Policy, I have a Part D pharmaceutical policy that has saved me thousands of dollars.  As a cardiac patient, my cardiologist has me on 6 daily drugs for which I have no co-pay. The only co-pay I’ve had to pay was very small on a couple of topical drugs and on a prednisone dose pack.

    For the record, my supplemental is with Mutual of Omaha and the Part D is with Wellcare (used to be Aetna).

    The Advantage plans that are available to you depends on the County in which you live. Austin County has some pretty poor choices.

    If I lived down there, I would consider the Kelsey-Seybold Advantage or the Memorial Hermann Advantage. They are both highly rated.

    I, too, have a Part D prescription plan, but – frustratingly – I’ve never met the deductible.

    But ELGordo has convinced me to keep buying it because if something happens and alluva sudden I’m on a bunch of expensive drugs, I’ll be glad that I have it.

    I was able to get my dried eggs out of Fred and load him up again.  Ran the dried stuff through the blender.  Tooke the time to wash and label my jars of beef that I recently canned. (The jars had some residual fat on them from the canning process.  Don’t want to put THAT on my shelf! Yuck!)

    I then washed my egg shells so that I can later dry them in the oven, run ’em through the blender, and use them in my garden.  When I can garden. /hopeful

    Washed the few dishes I dirtied up and then scrubbed the cooktop.  Hubby washes dishes and plays Jenga with them as he stacks them by the sink, but he doesn’t think about the cooktop.  I put dishes away – carefully, so the pyramid doesn’t fall to the floor – and clean the cooktop.

    By the time I finished all of that, I really needed to sit down.  But two days ago, that would have been impossible.   Going to rest a bit and then I have to go upstairs and start sorting out our future master bedroom.  All of that stuff will have to be moved out/around so that the radiant tubing and the flooring can go in.

    I save boxes, so I know I have some I can use for charitable donations.  And trash bags.  That place has become storage for construction/housing supplies, yarn, and other miscellaneous stuff.

    Morning, gang. Spring is definitely here at Chez Harp. I have colorful plants going wild. I’ve been amazed for a month by the Bridal Wreath bushes just going berserk covered with dense white flowers. They must have enjoyed the cold spells we had. I have bright pink and pale pink azalea bushes in bloom. Near my front curb is a defunct lamp pole, that never worked since we bought the house in 1995. There are some houses here that have kept their namesake “Candlelight” posts going. What ours has done for those 28 years is support a massive Carolina jessamine vine, covered with yellow flowers from early Spring till summer heat. I just noticed yesterday that the redbud beside the driveway was in full color. That is a brief knockout, seen from the street, but barely visible from the house side due to oak branches in 80YO’s yard.

    In the back yard, the most colorful plant is a huge Loropetalum fringe flower tree, which puts on bright red flowers in both Spring and Autumn.

    My crepe myrtles took quite a hit during the cold spells and have very little foliage so far this year, much less any flowers.

    Once you’ve decided to go the Traditional/ Supplement route, choosing a Supplement isn’t really that complicated. These companies can only offer six (seven?) different options – with different deductibles. The government defines these options.

    There’s not much rate competition among the Supplement companies, but you might be able to save a few bucks by shopping.

    Fay had wonderful service from State Farm her entire Medicare experience.

    Mine is with Thrivent, a Lutheran service organization.

    I’ve long said that one way to end all of this BS about there being no differences between men and woman, you can identify as whatever sex you want, the inability of our newest Supreme Court Justice being able to even define what a woman is, etc is to make EVERYONE register for Selective Service when they are 18 (and require those up to age 35 that are not already registered—because they are probably what we used to call women—to register immediately). I truly believe most in the USA would flip-out and would then start realizing there are differences and suddenly everyone would be able to define what a woman is. They wouldn’t want their daughters, wives, sisters dying in a foreign country. Their arguments against requiring women to register would be their undoing. You cannot have it both ways. If the liberals started saying that the Republicans are trying to put females in harm’s way, the Republicans should say that the liberals all want equity, no differences AND what is more equitable than treating EVERYONE fairly with Selective Service, especially since there really no men or women…..just people.

    I am saying this as a female veteran of the USMC. The time to do this is RIGHT NOW with the possibility of war looming.

    The majority of Americans are ‘normies’ who flock to whichever crowd seems more popular at the moment. They are VERY easily swayed by propaganda, especially the fear-porn variety.     I must be missing something. I work retail and have had to manage employees who start crying because a customer looks at them the wrong way. If that’s the shape these people are in, I hate to see what comes along and 20 years. I agree all generations are different, but we’re certainly not headed in a positive direction right now in my opinion.

    I can make my 18-year-old run to mama crying if I furrow my brow in response to something he said. I’m working on toughening him up in order to get through real life.

    When I was doing business in Muslim countries Ramadan was always interesting.  Ramadan moves throughout the months year over year and requires total fasting from dawn to dusk.  It has the least impact when occurring during winter months with long nights and short days.  However, when Ramadan falls in the May to September period, things get pretty crazy because observant Muslims are fasting for very long daylight hours plus the five five prayer periods during the day.

    If I could get anybody to answer a phone in an office over there, they might sound weak or spaced out or semi-coherent.  I had to really scrutinize email and fax communications for goofy mistakes.  It was also pretty useless to try and get anything done with them after about 2 in the afternoon.

    Once the sun goes down, the men have nightly feasts at the mosques where they gorge themselves after starving for 13 or 14 hours.  Women and children are at home doing the same thing.  After a couple of weeks their metabolisms are so whacky, I thought some of them were hallucinating and this goes on for a month.

    The Plan D prescription drug policy is the biggest pain in the butt. Every year, at will, these companies can and do change their formularies – which is the list of drugs that they cover.

    So, you have to keep an eye out for the new formulary being issued. And then decide if you need to change companies by the end of the year.

    This year I just didn’t want to deal with it, so I blew it off and stayed with the same company.

    What a PITA.  At least her meds list was pretty stable.  That helped.  I feel for those whose health requires new or changing meds.  It’s a crap shoot then.

    I was at Kroger yesterday with a shopping list noting important things I was completely out of. Many of those were items from the pet food aisle, which I stocked up on as best I could. It has been years since I was able to get the dry dog chow that I used to put out for my night-time friends. The one pet food that has stayed reliably available is 10-lb bags of Wild Mix, which is corn kernels and sunflower seeds, popular with every type of critter that comes by day or night. I mostly put that out during the day when I notice squirrels on the patio. I also stock peanuts in the shell which is very popular with the squirrels. Most squirrels that live around here know to face the big windows and look cute if they see me looking out.

    I had peanuts in the shell on my list, and I buy those in 3 lb bags in the human snack aisle. I was in that aisle yesterday, but I failed to get peanuts. So yesterday the cute squirrels didn’t get any peanuts. I just now got back from Kroger, with peanuts this time…

    Those of you out there in the metropolitan areas should be aware that there are some very good people who are brokers for the assorted supplemental carriers.  Most of them represent more than one company, and they cost you nothing – they are paid by the company you eventually sign up with.  Your cost will be the same whether you use them or not.  No matter how smart you are, and no matter how good you can read, you cannot develop the degree of expertise that these people have as they are sent to seminars held by the companies they represent that give them all the in and outs.  The ones that I’ve known in both Dallas and in Houston have been very professional int their analysis and presentation and can truly help you select the best option for your needs.  And they can do in 30 minutes what you can do in six weeks of trying to figure out that stuff.  Since this market is also government regulated, the differences between the various plans are pretty small to begin with, so no matter what you do  it should not be catastrophic.

    Whatever your drug needs, keep the Part D alive.  I went for years losing money on maintaining Part D, and then all of a sudden I’ve got one expensive medication that made it all back the first year – and it’s for the rest of my life.  FWIW, out here Baylor Scott and White controls the market.  Their main hospital is in Temple, but they have hospitals and care facilities stretching from Dallas to Houston and all over central Texas.  I decided last year to enrolled in their program and I’ve been very satisfied.  That’s the place in Marble Falls that I go anyway, and I’ve got access to all their facilities and doctors throughout the system.  It’s not Methodist Hospital, but it’s not far off.  Temple is the closest Level V trauma center and is a short helicopter ride if you need it.   Of course, being in the Houston market spoils you with the level of medical care available throughout the area.  Just my $.02.

    Just another observation based on my experiences the pat few years.  The doctors know what they are doing and will prescribe the best course of action for your particular case.  They will generally sit around and consult with their peers informally, and will make referrals if the case requires more specialized care than they are capable of providing.  Now here’s the important part – they have gone to a lot of trouble, spent a lot of money, and consulted the brain trust; but if you choose to ignore their directions and go about your own merry way, self medicating when you want to rather than when they tell you to, engage in unapproved activities or conversely not religiously adhering to a prescribed rehab plan, then you are wasting your time and theirs – and you are driving up the costs to everyone else.  So either get with the program or forget it.   They generally know better what is good for you than you de.  You make decisions based on how you feel at any given time – they make decisions to heal you in the least possible time knowing that there will be some good days and some bad days as you progress.  Again, just my $.02

    PS – If you don’t have confidence in what your doctor is telling you, fire him and get another one – they have thick skin and will not be offended, and they already have more business than they can cover so they will probably be glad to be shed of a problem patient.

    PPS – Somewhat unrelated, but when reading reports, article, transcripts, and the like, if you generally stick to the black part and ignore the white part, your comprehensions will be greatly improved. Then you can form your opinions based on the black part which tends to be more reliable than the white part. Not necessarily applicable to government reports though.

    Just got to meet one of our men in blue – Hubby saw some guys robbing the house across from us.  Hubby tried to get a picture of the getaway Tahoe, but the image wasn’t good enough for plates.  He was able to give Officer Garza a good description of the vehicle and perps, and describe clearly what he saw.

    One of those things he saw was a long arm being put into said Tahoe.

    I guess we’ll finally get to meet our neighbors.  They’ve been there for several years, but pretty much keep to themselves.

    I’ll tell ya’ – I don’t want to piss off  Officer Garza.  That guy looks fit and ready to take down a rhino.

    Maybe we could send him to Austin or D.C.

    I got a medicare replacement HMO thru Humana  – chosen because it was the one with which my primary care doctor is in-network, and use their mail-order pharmacy – getting 3 months worth at a time for not much (many are covered 100%)… I think I pay something under $3.00/monthly for the plan. Unfortunately, if I read correctly, my primary MD is no longer in network with them… Guess I have to figure out where to go from here.

    Hubby LOVES mowing the yard in our zero turn mower.  I think he loves that thing almost as much as he loves his car baby.

    In his enthusiasm, he gave my brand new rose bush a pretty severe haircut.  I think it’ll come back, though, and Handyman just put a couple of stakes up to keep Hubby from repeating his mistake.

    The rose bush may come back, but I’ve managed to take out my new rosemary bush.  That’s one.

    I wonder if part of their problem are the rumors that Harry isn’t really “royal” blood, being the bastard son of Diana’s liaison with…some guy who ran the stables or some such.

    I’ve seen a picture of the two, Harry and the supposed father, and there is quite a resemblance.

    Kinda like Chelsea Clinton and that weak chinned Webb Hubbell.  She looks just like him. Well, pre-plastic surgery.     I remember vaguely mentioning that my favorite casserole is Chicken-Rice-A-Roni casserole – but the Rice-A-Roni has way to high a sodium content to make me happy (or my Blood Pressure, specifically)… Fast forward to getting that casserole going for tonight’s potluck – I had no CHICKEN rice-a-roni, so google being my friend, I found a recipe for home-made rice-a-roni and, as soon as I remember to get low-sodium chicken bullion, problem solved… Well, we’ll see if the casserole is as good as usual, but I think it’s gonna be fine, from tasting the bowl scrapings (since the chicken was from a can and fully cooked)   😉

    Late to join in today and am reading today’s comments from the start.  But the comments on Medicare and Medicare Supplements early on today have me putting in my and our experience with our Blue Cross Medicare Advantage  Choice Premier policies.  They have given us excellent coverage from Blue Cross and Blue Shield of Texas.  And their drug coverage has been very good as well.  Thus far nobody has turned their nose up at our insurance coverage. 🙂

    Now back to reading early comments.

    FYI Pascha is the Sunday after Easter this year and falls on the 16th of April.

    When I lived in Casablanca in 2010, Ramadan started the second week of August. Thirteen years later it starts the third week of March.

    Texpat is right about the Muslims almost becoming delirious when fasting during the summer months. I hate to say it but I took full advantage of the situation when I bought my Excursion from some Pakistani fellows during Ramadan in late June. At 2 pm they were pretty beat down and I kept driving a hard bargain. A good deal turned into a very good deal for me.

    I managed to salvage two non-sealed jars of beef. I tossed ’em into a pan (my new carbon steel pan, which I’m enjoying very much) and began cooking down the liquid.  While that was going on, I found a coupla bell peppers that were heading for the door and some matching tomatoes.  I cut those up along with some onion and that all joined the beef.  Threw in some seasonings and a side salad and dinner was served.

    Hubby loved it, and there’s enough left over for his dinner tomorrow, unless he goes to his car club meeting.  Then it’ll be Friday or Saturday night.

    Then I made two rosaries.  I screwed one up and since it was threaded and not chained, it was difficult to save without restringing it.  I managed, but it’s not my prettiest salvage job.

    So now I go on to my Latin.

    Looks like the traditional Medicare and supplement will work best for me since I see so many specialists, my wife won’t be 65 until January but the Advantage may be best for her since she rarely goes to a doctor and takes no medications. I don’t have to decide until May. I like this lady, she carries all the packages and doesn’t care what you pick. She mentioned the AARP benefits and without me saying anything she says I don’t believe in them politically but they do offer many good things. She’s on our team!

    Oh, and Hubby was in his truck listening to his radio when the neighbor across the street came over.  I guess the cops gave him the info that Hubby interrupted their home being burgled.  We have their info and vice versa now, as well as the guy on the other side of neighbor’s house.  They only got away with a long gun and a gym bag of stuff.  It could’ve been much worse.

    Hubby said the victim came back and tried to give Hubby money.  Hubby refused repeatedly.  We don’t want money, but it was a nice gesture.

    I’m going to contact the neighbors two houses down on our side of the street and exchange info.  I’m already in watch sharing mode with the other two “touching” neighbors.  The best defense we have is to watch out for each other.

    I was considering bed early again tonight, but it looks like SpaceX is planning a launch here in a couple of hours.  I’ll stay up and watch what all goes on in today’s world of space travel, admire the latest in space travel fashion garb and accessories, learn some new words, and the like.  I seldom turn on the TV in my bedroom, but if I decide to go to bed before blast off I can always turn it on back there and sleep through the main event but catch a later re-run.  But as it stands, I’ll try to stay up for the launch.  It’s a lit different that it was when I was watching Mercury and Gemini and Apollo and such back in the day.
