Tuesday “Composting Equine” Open Comments

Shortly before I signed off Monday night, I brought up the fact that certain arguments here have been hashed, rehashed, refried, then reborn to be rehashed again.  What is it in us that makes us go over the same things over and over?  A desire to be deemed “right”?  Our inability to accept that some people are idiots and will remain idiots, no matter how hard we shove facts at them?  (And as Queen, I reserve the right to title the idiots in my company.  Well,  when my royal status is recognized, anyway.  (smiley-face thingie)).  Does it do any good?
Birthers, for example.  One might say that their haranguing the legal system regarding Obama’s birth certificate, his Indonesian citizenship, etc., might be a composting equine position.  But it seems that it might finally be getting somewhere, with a few Democrats wanting to shut them up by granting access to the certificate, albeit for a small fee.  Which I think is stupid.  Once the first birther gets their hands on it, he will either deny its authenticity, which will bring a whole new slew of arguments, or he will display it for all to see, which means only one person need pay the $100.  But I digress – has their beating that poor animal after its expiration actually gotten them somewhere?
And then there’s the atheism-Christian argument regarding the whole “where’d we come from” question.  Will arguing about it change anything?  Will people change their minds, in numbers enough to mean anything?
And don’t get started on the War on Drugs.  That WOD of a problem has consumed many threads here at Hammy’s Comfy Couch.  We all know who the guilty parties are, so names will not be mentioned.
What is it that drives us?  I see this on the left, on the right, even the “moderates” argue their “moderateness” and look upon it as a badge of honor. Is it something in our DNA that keeps us returning to that composting equine with our sticks, to wreak more havoc upon the carcass?  With gas masks, of course.
Question:  Do we argue because we love to argue?  Because we all have an innate desire to be declared “right”?  Or do we actually think we’ll change minds? Or are we so passionate about certain topics that we simply cannot fathom anyone thinking differently? And how many times has the revisiting a dead horse with clubs in hand affected or changed our society?  (Examples, please.)
I look at the foregoing paragraph and see myself reflected in several of those reasons.  What drives you?

    The main reason these subjects get brought up is not a desire to have open and honest discussion. Rather, they are brought up as a platform to bash Republicans, Conservatives, and Christians. It is purely political and merely the latest iteration of Mobyism, of the type we saw on LST for years.

    Both the WoD rant and the Evolution rant are prime examples. They give the gentleman the opportunity to use words like “authoritarian” and to cast Believers as ignorant. The idea is to draw out commenters who might make statements that can then be used, with shakey credibility, to illustrate those points. The goal is to keep certain hateful concepts in the public mind: that Conservatives (and Christians) are threats to out Liberty and desire to create authoritarian rule in this country and that Conservatives (and Christians) are ignent knuckle dragging troglodytes.

    Its not just here, its all over the internet. It is the kind of cowardly and hateful tactics ones uses when one’s side has no real argument or is losing badly.

    It IS biogtry, both political and religious, and we should call it out for what it is instead of falling into the trap. When we do that, the subject becomes the hatred and bigotry, not the manufactured concepts.

    However, in modern business, education and government (and blogosphere), a whole range of far more advanced strategies are often employed, such as: « When you discover that you are riding a dead horse, the best strategy is to

    1. Buy a stronger whip.
    2. Change riders.
    3. Threaten the horse with termination.
    4. Appoint a committee to study the horse.
    5. Arrange to visit other countries to see how others ride dead horses.
    6. Lower the standards so that dead horses can be included.
    7. Reclassify the dead horse as “living impaired”.
    8. Hire outside contractors to ride the dead horse.
    9. Harness several dead horses together to increase the speed.
    10. Provide additional funding and/or training to increase the dead horse’s
    performance.
    11. Do a productivity study to see if lighter riders would improve the dead
    horse’s performance.
    12. Declare that as the dead horse does not have to be fed, it is less costly,
    carries lower overhead and therefore contributes substantially more to the
    bottom line of the economy than do some other horses.

    I do not believe that allowing fraudulent statements to stand unchallenged is prudent. Claiming that evolution is science and ID is not is fraudulent (intellectual flatulence) and must not be allowed to stand.
    Other examples:
    conservatives are racist, bigoted, homophobic, xenophobic hatemongers.
    Believers in the Messiah are intolerant of other beliefs
    conservatives are not compassionate
    political correctness is correct

    I quit arguing years ago. As I have posted here before, I state my opinion and shut up. You are then free to do as you please with it. You can build a shrine around it or put it in the bottom of the bird cage. If you post a varying opinion, I will read and digest it to expound my thinking on the subject.

The only real way to keep from seeing the dead horse being flayed about is to change the subject to the motivations and biases of the person instroducing the subject into the conversation, and the rhetoric used to do so. Rarely is the subject introduced without some sort of invective insult or demonizing language.

    Remember:

    The mantra of the Left is that we are all racist, crazy, or stupid dupes (or any combination or iteration of those three). Whenever these subjects are introduced, the motive is to reinforce those concepts. Make them the subject, not Conservative or Christian beliefs. Make it more costly to them to bring the subject up than what they might gain by doing so.

    An open letter to citizen revolutionaries everywhere:
    So, you’ve toppled your dictator and you’re celebrating your nation’s liberation from tyranny.
    Congratulations!
    Now what?
    If you’re an aspiring tyrant yourself, you already know what you’re going to do. But if you’re like hundreds of millions of people around the world, you want to live in freedom. You don’t want to trade one tyrant for another. You want liberty and prosperity and a normal life, the kind of life that people have when they live in a free country.
    But how do you set up a free country?
    It’s easier than you think.
    Freedom is not a mystical and incomprehensible force that penetrates some borders and not others. It’s simple: Freedom is a condition that exists under a government of limited power.
    Don’t make the mistake of thinking elections are the key to freedom. Limited government power is the key to freedom. Without limits on government power, elections are just mob rule.
    So if you want to set up a free country, the first thing you need is a written Constitution that sets up a government and identifies exactly what it is allowed to do. It’s a good idea to divide the government into sections as a safeguard. Limit the power of the government, then limit the power of each section of the government, then limit the terms of each person in the government.
    You may want to spell out the rights that all citizens have, rights that the government will not be permitted to infringe. Even though you’ve already limited the power of the government, it never hurts to be extra clear that you really mean it.
    It’s very important to have an independent judiciary. Make sure your judges can’t be fired by government officials who don’t like their rulings. You don’t have a free country unless the law applies to everybody, especially government officials.
    You may not be a fan of the British Empire, but if you want to set up a free country you’ll like the work of Sir William Blackstone, the 18th century legal scholar who said the fundamental rights of free men are life, liberty and property.
    Blackstone wrote that the foundation of freedom was the right to your own life and limbs, the right to move freely from place to place, and the right to own and enjoy your property. In a free country these rights can be taken away only by “due process of law” and not by arbitrary power. An example of due process would be a properly authorized law enforcement action and a fair trial. An example of arbitrary power would be someone knocking down your door and taking you away in the night, then holding you for some indefinite period on some unspecified charge.
    Whatever you do, don’t make the mistake of thinking that all the goods and services produced in your country belong to everyone, and the government’s job is to distribute them fairly. It may sound like a good idea, but it makes the government all-powerful, and then you’re not living in a free country. Freedom is a condition that exists under a government of limited power. In a free country, the goods and services produced belong to the individuals who produce them, and the government’s job is to protect private property from those who would take it by force or by fraud.
    When people can keep the fruits of their own labor, they are free to study and invest and work and build, secure in the knowledge that eventually they will reap the benefits of their efforts. That’s how freedom creates prosperity.
    When everything belongs to everybody and the government is the distributor, there is no incentive to study, invest, work or build. That’s how collectivism creates poverty.
    Really, it’s simple. Limit the power of government, protect the individual’s right to life, liberty and property, pick out a national anthem, and join the free world.

    Apparently, at a Lubbock school fundraiser Palin was the guest speaker at, security would not allow any arms inside, even with a concealed carry permit. The Lubbock Police Department stated no one questioned the forbidding of guns by Palin’s staff, and and even Palin indicated she would do so at all future engagements. Apparently neither Texas law nor Second Amendment rights apply to those more important than the constitution.

If it has the power to compel an otherwise passive individual into a commercial transaction with a third party merely by asserting — as was done in the Act — that compelling the actual transaction is itself “commercial and economic in nature, and substantially affects interstate commerce” [see Act § 1501(a)(1)], it is not hyperbolizing to suggest that Congress could do almost anything it wanted. It is difficult to imagine that a nation which began, at least in part, as the result of opposition to a British mandate giving the East India Company a monopoly and imposing a nominal tax on all tea sold in America would have set out to create a government with the power to force people to buy tea in the first place. If Congress can penalize a passive individual for failing to engage in commerce, the enumeration of powers in the Constitution would have been in vain for it would be “difficult to perceive any limitation on federal power” [Lopez, supra, 514 U.S. at 564], and we would have a Constitution in name only. Surely this is not what the Founding Fathers could have intended.

    I’m glad he addressed this issue in the large sense, but something still doesn’t make sense to me. Several non-legal minds (including mine) questioned how the fed could legally invoke The Interstate Commerce Clause to justify mandating a purchase of services which you can not purchase across state lines. It seems to me that it doesn’t fit the very definition itself, so how could that have ever been a valid justification in the first place? Anyway, this was a great ruling.

    I often seem to hear various polls being conducted about what is more important or less important than something else, or whose fault is it that something happened, etc.; normally followed by a few answers to select from – none of which are appealing. I heard one this morning discussing Sunday liquor sales and talking about how much more tax money it would raise, etc. and soliciting some opinion or another. Seems like almost every day some politician is coming up with some new way to raise a fee or tax my neighbor but not tax me or some other such nonsense, and I think I may have stumbled upon a simple, universal answer for all those questions – “cut spending.” Every time someone wants to raise the zoo fees or parking ticket fines or motel taxes (taxes the out of towner you know, not the local voter) just respond with “cut spending.”

    What do you think about that, assuming you are not smoking dope and are capable of thinking at all?

    I often seem to hear various polls being conducted about what is more important or less important than something else, or whose fault is it that something happened, etc.; normally followed by a few answers to select from – none of which are appealing. I heard one this morning discussing Sunday liquor sales and talking about how much more tax money it would raise, etc. and soliciting some opinion or another. Seems like almost every day some politician is coming up with some new way to raise a fee or tax my neighbor but not tax me or some other such nonsense, and I think I may have stumbled upon a simple, universal answer for all those questions – “cut spending.” Every time someone wants to raise the zoo fees or parking ticket fines or motel taxes (taxes the out of towner you know, not the local voter) just respond with “cut spending.”
    What do you think about that, assuming you are not smoking dope and are capable of thinking at all?

    The characterization made that Palin prohibits guns is false.

    It is against Federal Law to have a gun at school. All that is being done is the speaker—any speaker—at a school is making the requirement that Federal Law be followed.

    This passage is especially mendacious:

    Her staff enforced what the local press called “tight security.” Despite a Texas law that forbids the banning of concealed handguns held by Texas permit-holders in public venues, all members of the audience had to bring a photo ID, pass through metal detectors, and anyone who tried to bring in a weapon, permit or not, was subject to arrest.

    It is currently against Texas Law for CCL holders to take thier weapons onto College Campii, and as mentioned above, it is against Federal Law to take them onto public school grounds. There has been a bill introduced in the Lege to allow CCL holders to take thier weapons onto College Campii, but that will not affect the prohibition on weapons in public schools.

    The man is either ignorant of the law, or intentionally lying to make Palin look bad to Conservatives who hold Gun Rights dear. Since the source labels itself as “The Progessive Voice”, I’d lean towards intentional lying.

    How do I know this?

    Because for 10 years I was involved with TPWD’s Living History Program making presentations at Public Schools all across Texas. One might imagine how difficult it is to interpret the Second World War, the Indian Wars, and the Spanish American War without the display of firearms, but they wwere an integral part of each program. In each and every case, we had to get a special waiver to bring weapons onto the property, and then were restricted to football fields or other outdoor facilities and areas. Even as a State Museum Volunteers who had passed background checks (done by the Secret Service when we hosted an event at the Nimitz Museum that featured President and then Governor Bush) we were never allowed to take them inside the buildings.

    In 1998, I participated in the Centerville 4th of July Parade along with six other volunteers dressed in Spanish American War uniforms and carrying period weapons as part of an effort to promote a 100th Anniversary event at the Texas State Railroad. Our group had to form separately in an office parking lot and join the parade as it passed us. That was because the parade started in the High School parking lot and we did not have a waiver.

    I also learned that in a town as small as Centerville, one of the features of the parade is the new truck for the local septic sucking service.

    I’m finally getting my act together. I ran hard and long yesterday, functioning pretty much on adrenaline for most of the day. I had a meeting last night, and I could feel the relief and relaxation as my body started slowing down as the adrenaline left my system. I won’t say I almost fell asleep in the meeting, but it was tempting!

    I got home and relaxed for a few minutes. Handsome had brought home some red velvet cake from work, as a thank you for me helping him get his temporary license in the morning. BTW, if anyone finds his wallet, we would really appreciate your returning it to him. I watched some Stargate Atlantis and ate some cake before heading upstairs to do one final task for Hubby. I got to bed around 1:30 in the morning.

    Hubby didn’t wake me up this morning (as if he could). I got up, checked my garden, ate some breakfast, prayed and read a little, and am now beginning my day. I appreciate that my post generated some conversation this morning. It’s interesting, and a little scary sometimes, to see how everyone here thinks. 😉

    And Hammy, I loved your list. I needed the laugh.

    Now, on to everything I didn’t get done yesterday, the stuff I had schedule for today, and my 2″ high pile of mail….

    possess a firearm that has moved in or that otherwise affects
    interstate or foreign commerce at a place that the individual
    knows, or has reasonable cause to believe, is a school zone.
    (B) Subparagraph (A) does not apply to the possession of a
    firearm –
    (i) on private property not part of school grounds;
    (ii) if the individual possessing the firearm is licensed to do
    so by the State in which the school zone is located or a
    political subdivision of the State, and the law of the State or
    political subdivision requires that, before an individual obtains
    such a license, the law enforcement authorities of the State or
    political subdivision verify that the individual is qualified
    under law to receive the license;
    (iii) that is –
    (I) not loaded; and
    (II) in a locked container, or a locked firearms rack that is
    on a motor vehicle;
    (iv) by an individual for use in a program approved by a school
    in the school zone;
    (v) by an individual in accordance with a contract entered into
    between a school in the school zone and the individual or an
    employer of the individual;
    (vi) by a law enforcement officer acting in his or her official
    capacity; or
    (vii) that is unloaded and is possessed by an individual while
    traversing school premises for the purpose of gaining access to
    public or private lands open to hunting, if the entry on school
    premises is authorized by school authorities.
    (3)(A) Except as provided in subparagraph (B), it shall be
    unlawful for any person, knowingly or with reckless disregard for
    the safety of another, to discharge or attempt to discharge a
    firearm that has moved in or that otherwise affects interstate or

They only started the “She’s a crazy wing nut” routine after Conservatives embarced her, and Christians welcomed her with the spirit of forgiveness and redemption that is so sorely misunderstood by the Left.

    This “Palin is against gun rights” allegation by the Left is of the same sort of rhetoric.

    Good morning all. Batten down for the big chill to come tonight. Started out at a humid 68 at 5:30, wet pavement mostly from overnight fog and a few brief showers. All that changed by 6 when the first big whoosh blasted in with driving rain and wild gusts that pulled the proch banners off their anchorage and left them whipping in the wind, dangling by one hook. Rescued them and brought them inside.

    Barn doors rattled, rain drummed on the barn roof, and closing and latching the only open window on the north side took some doing. Cameo appreciated having her stall less breezy so she could eat her hay in peace. Mara and Contessa across the aisle appreciated the closed window as well, though theirs, being on the south side, remained open. Checked the water buckets and topped them off, then opened the front doors enough to get out and wrestled the umbrella with one hand and closed the doors with the other. Pushed the people gate closed and made it up the path to the back porch without getting very wet or losing the umbrella. The home weather station said 41 with windchill 36. A cup of hot tea sure was welcome.

    Game plan for dealing with the freezing temps is set, outdoor faucet covers at the ready, old sheets and frost cloth stacked up, garage space cleared and waiting for planters. Thermometer on the front proch just slipped to 37, but it’s open to the north, windchill now 31.
    Must start carrying plants into the garage.

    Hang in there everybody.

    My High School Civics understanding of the Federal Court System is a little rusty, but as I understand it…if a Federal Judge or Federal Circuit Court “interprets”, “devines”, or just plain “guesses” the application of the law; then that ruling is subject to reversal by a higher court. I am told it has happened many times.

    Article Two of the United States Constitution (Section 4) states that “The President, Vice President, and all other civil Officers of the United States shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other High Crimes and Misdemeanors.” The House of Representatives has the sole power of impeaching, while the United States Senate has the sole power to try all impeachments

    Being bone-headed (sorry), stupid, mistaken, and just plain old wrong does not rise to the level of High Crimes and Misdeanors. Maybe it should, but that will require an amendment to the Constitution.     Sylvester Byrd was arrested Sunday on an aggravated battery with a deadly weapon charge in connection with what could be considered an udderly unusual case.

    The 36-year-old victim told Fort Pierce police he was talking with Byrd “about cows and other farm animals” in the backyard of an address in the 800 block of Texas Court when an argument began.

    Byrd, however, told police he and his girlfriend were in the backyard. He said the victim came over and started disrespecting his girlfriend. Byrd said they argued and the victim grabbed his arm.

    “He said in self defense he clawed (the victim) across the face, scratching him with his nails,” the affidavit states.

    Byrd said that’s when the machete came out. He said he got the weapon because the victim is larger than he is. He said he chased the victim and fell before putting up the machete and hoofing it to a friend’s house. Byrd denied cutting the victim with the machete.

    Byrd’s 68-year-old girlfriend told police the victim and Byrd “were talking about farm animals and milking cows.”

    “She said Byrd stated how the cows were milked by their udders and (the victim) stated how they were milked by a machine,” the affidavit states. “She advised she basically ignored their conversation, but due to this discrepancy an argument broke out between (the victim) and Byrd.”

    The girlfriend said Byrd got his machete after the apparent beef over cow milking and chased the victim.

    Someone likes their puns. Someone else doesn’t know that machines can get hooked up to udders. Basically we had the ignorant arguing over something he knew little or nothing about.

My contention (gripe) is that we (reasonable conservatives) have been beat down for so long that we dare not say that the emperor is nekkid. There has been a concerted effort over the last 40 years or so to promote the notion that the constitution is a living breathing document, instead of a set of restrictions n the Federal govt. The first big power usurpation took place with Marbury v Madison and we get the confusion that only the judge can know what the law means (interprets) instead of the law being clear and the judge determines how it fits with the varied cases that come before him. This is a critical distinction, if you go with the former you no longer have the rule of law – you have rule of whim of the judge on a particular day. If you go with the latter, the judge really has to jump through hoops and other legal/mental gymnastics to advance his agenda instead of advancing the clear intent of the law and generally speaking rule of law prevails. Guess which side I am on??

    I am vaguely aware of the concept of strict interpretation of the Constitution. I am also aware that at different times the Executive and Legislative branches under BOTH parties have liberally interpreted the Constitution when it met their needs.
    I suspect that the fights between the different branches are just what the framers had in mind.
    When you have the Legislative Branch dismissing judges when they don’t like the rulings, then you might as well close down the courts because they will be controlled by the Executive and Legislative branches.
    Justice and Democracy are a lot like making sausage. A pretty revolting process to witness, but in the end a product that is more or less appealing.

    I am pleased that we have not had to turn on the heat yet. Our insulation in our well-insulated house is well worth it. I could probably wait until 10:00 or so to turn it on, but Hubby seems to get cold easily these days.

    It used to be the other way around.

    There was an individual that frequented the hallowed halls of LST that enjoyed tweaking folks with some inane argument about whether the Texas flag could be higher than the US flag or some crappola like that.

    As moderator, handyman and all round nice guy (now retired) of that esteemed project I never lost my since of wonder at the amount of people that got their knickers in a twist over that asinine argument. I quietly read every line of the back and forth and never once replied or got involved directly.

    In the spirit of the original premise of horse beating that Tedtam eluded too I will take this opportunity to respond to your question. I do this because I feel like you and I have a fairly decent relationship built on semi-mutual respect and trust. 😉

    I consider myself an originalist and to answer your question(s) I would ask you a question.

    I was working at home today (my company laptop on the breakfast room table, wireless to home router, VPN to company network) when I heard a loud scary noise from the kitchen cabinets. It sounded like a big mouse’s scrabbling feet in a high cabinet up over the countertop. I was debating whether to fetch the broom when suddenly one of the cabinet doors flew open and my big fluffy cat Travis jumped out. I have no idea how he got in there without attracting my notice.

On the way in, a stork tries to get one of them to take a package it was holding in its beak, and the woman smiled and waved the baby away. Then she and some other women were in the boutique, shopping for things like a trip to Paris and a new house. The last shot of of the women is them smiling, driving away in a car with their new purchases.

    I guess children are only to be considered things that get in the way of things we want to buy. This message appeals to the most selfish part of ourselves.
